Design and Development of a Land Parcel Identification System based on Cadastral and Rural Registrations

The thesis entitled "Design and Development of a Land Parcel Identification System based on Cadastral and Rural Registrations" was held at the Sector of Cadastre, Photogrammetry and Cartography of the Department of Rural and Surveying Engineering, at the Aristotle University of Thessaloniki. The supervisor was the Professor of the Department of Rural and Surveying Engineering, AUTH, Mr Apostolos Arvanitis. The issue that this thesis approaches is the creation of a Rural Land Administration System taking into consideration international standards and Regulations, that can assume the role of a Land Administration System.The necessity of this system is imposed by the Council Regulation (EC) No 1593/2000, according to which a land parcel identification system is mandatory (starting in 2005) for the identification of agricultural parcels and shall be established on the basis of maps or land registry documents with the use of computerised geographical information system techniques.Although all member states of the EU have designated their respective information systems, there are still many unresolved issues relating primarily on accuracy and reliability of these systems. There are few cases subsequent to the Court's audits where problems in the registers of the above systems in almost all member countries have been recorded.Similarly, in the case of Greece, today (2014) there is no reliable system to record and manage the rural property. In the absence of this system Greece fails to plan its agricultural productivity based on a land registry and to meet the requirements set by the European requirements regarding crop subsidies received each year for which retrospectively pay exorbitant fines for non-compliance with them. In the frame of the need for reliable Rural Land Administration System and whereas today respected in all countries Information systems in agricultural records (such as LPIS) and in cadastral registers (Register Land) -ie. spatial data systems containing the same information and with the same form- the issue of correlation or merger of these two systems is set. In such a correlation registers not only reduces the cost and time created by the simultaneous existence, maintenance and update, but given the possibility of creating a multidimensional system of geoinformation. The aim is to increase the quality of the information through the standardization of data so as to improve the way land parcel identification.Although these two systems seem to be "similar", there are many problems that occur that make the direct connection of these two systems incapable.The questions that are been raised and are investigated in this thesis are:4.Is it necessary to preserve two parallel and identical land registration systems (LPIS and Cadastre)? Can and should these two systems be merged? Is it needed any of them to be repealed? If so, based on which conditions should all of the above mentioned be done?5.Following the above question and on the basis of running an up to date land parcel identification system with cadastral and agricultural land registers, what is the optimal way to manage the system to avoid on the spot checks? 6.Why in other European countries respective data haven’t already been homogeneous given the existence of Land Register much earlier in relation to Greece;For all these reasons, the thesis focuses on the design and implementation of a Land Parcel Identification System model, taking into consideration both agricultural registers and other cadastral registration systems. The thesis explores the development of a Land Parcel Identification System model that can assume the role of a Land Administration System. Through this model a prototype association of the LPIS (Land Parcel Identification System) models of the member States of the European Union with their respective Cadastral systems is performed. Moreover, attempts are made, with the goal of creating an original Greek Land Administration Model (GR_LADM) based on the correlation of the afore mentioned model with the Land Administration Domain Model (LADM, ISO19152). The correlation is being performed based on the specific features of the Greek case, as the general context of the LADM does not provide the relationships and traits that can lead to solutions in cases of specialized models or in cases of individual country features. The reference used in the Land Parcel Identification System (which from now on will be called Cadastral LPIS) is the model resulting from the connection of the Greek Cadastre and the Greek Land Parcel Identification System. It was designed in accordance with the Technical Specifications of the National Cadastre, the Greek Land Parcel Identification System model, the LPIS Core Conceptual Model (LCM), the Land Administration Domain Model (LADM, ISO 19152) and the corresponding Greek and European legislation. At the same time, the connection of the Cadastral Parcel with the terms referring to Cadastral Sub-Parcel (which is already used in a similar way as spatial unit in the corresponding registries) and to Cadastral Multi-Parcel (which is a new term-of this thesis- representing of spatial unit) is proposed. The data used during the Cadastral LPIS implementation were: the cadastral map of the rural area of Nea Anchialos Municipal Unit -part of the municipality of Volos in Magnesia Regional Unit- in digital format, the digital orthophoto of the area and part of the Descriptive Database of the National Cadastre for that same area. More specifically, the structure of the thesis is the following: At the beginning, the Land Parcel Identification System (LPIS) is presented, as well as its current status in Greece. The Land Parcel Identification System (LPIS) is one of the main elements of the Integrated Administration and Control System (IACS) as it allows the identification, detection and measurement of land parcels. According to Reg 1146/2010, it is a key element in the process of ensuring correct payments to farmers and safeguarding the resources of the European Union. It is the only safeguard of the IACS of the Common Agricultural Policy (CAP) that financial aid payment, according to the parcel area, is made in eligible areas and to a single beneficiary on the same parcel. In Greece this regulation applies as of January 1st, 2006 under the new CAP, and as of January 1st, 2009 it also has a cartographic background created with satellite images of the years 2007 and 2008. The data of the Spatial database include all spatial data described in the Single Payment Application and are depicted on a digital map consisting of layers (Payment and Control Agency for Guidance and Guarantee Community Aid of Greece, 2013). Its descriptive data consist of all the information relating to the identity of the farmer and the land parcels declared in the single application. Subsequently, in Chapter 2, the key elements of the National Cadastre relating to agricultural land registration are described. The basic Cartography data of the Cadastre consists of orthophoto maps, which were created in earlier cadastral programs, mainly through photogrammetric processes and surface methods in some areas. They are in a scale of 1:5.000 for rural areas and 1:1.000 for urban areas. In addition to the orthophotos mentioned above, and for the purpose of mapping the new cadastral maps, under the program of the new cadastral projects, one of the most recent and modern methods of mapping was created, which, among other data, consists of large-scale orthophotos (LSO): These are color (true color) digital orthophotos, the spatial resolution of which is 50 cm (Large Scale Orthophotos, LSO), covering the entire area which is under cadastral survey and form the basis of cadastral survey for rural areas. The spatial database of the National Cadastre consists of cadastral diagrams in digital form. The spatial information gathered is introduced and then structured in a Geographic Information System in accordance with specific standards and encodings. The descriptive database of the National Lands (Cadastre) includes all of the information collected and processed after the submission of the property ownership statement (Statement of Law 2308/1995). In the 3rd chapter the European experience of agricultural registrations is analyzed and the land registration systems implemented in some member States, their characteristics and their difficulties are presented. The member States of the EU, as part of the integrated system and in particular the Land Parcel Identification System, adopted various forms of rural land registration. The criteria by which they have chosen their own registration system depend on the particular characteristics of each country (eg the legal framework for land registration) and the already created information systems (existing mapping etc.). Based on LPIS reports in the member States of the EU it was noted that although this is a land parcel identification system with common characteristics, common standards and common reference, each member country keeps its own procedures and processes in order to reach the final 'product' which is the LPIS. Another important observation is that there are countries that use the Cadastre either as a background or as a parallel database for the European subsidy controls based on LPIS, but there are also countries that do not use it or they did so in the past and now they have abandoned it. The presentation of the model of the Cadastral LPIS is made in the 4th Chapter. Firstly, the correlation between LPIS and the Cadastre is analysed and the 'key' elements of the two systems are examined. The common characteristics of the National Cadastre and the Land Parcel Identification System are presented, with respect to their organization and operation processes, and also in relation to the nature and type of the information collected. These data may lead to a correlation between the two systems. However, there are significant differences between the two registries, which calls for further study as to the correlation of these two systems. In the process of the correlation of the two systems (the National Cadastre and the Land Parcel Identification System), a number of issues on cartographic data were examined, the most important of which are: Which of the two registration systems is more up todate.Which registry is more accurate. The reliability of both systems.Based on the special characteristics of our country and as to how land parcels and general data relating to land are registered, a novel connection of Cadastral and Agricultural land registration is proposed, in order to create a Land Parcel Identification System model (Cadastral LPIS) especially for Greece. This model uses the Cadastre as its main point of reference, and additionally processes the data coming from farm registers. To create the model of the Cadastral LPIS two terms were coined, referring to cadastral parcels: the Cadastral Sub-Parcel and the Cadastral Multi-Parcel.In brief, the methodology used in order to create the Cadastral LPIS is the following: 1.Creating a Spatial Model. The Cadastre (Cadastral parcel) is defined as the main point of information reference, "over" which will "overlap" the information reference of the LPIS (agricultural parcel). The below actions are followed:Identification of centroids. The centroid point of the cadastral parcel should coincide with the centroid of the respective agricultural parcel.Identification of parcels boundaries. The boundaries of the polygon representing the cadastral parcel should coincide with the boundaries of the polygon that represents the corresponding agricultural parcel.Identification of parcels areas. The area of the cadastral parcel should be identical to the area of the the corresponding agricultural parcel.2.Creating a Descriptive Model.The model is based on the correlation between the entities of the two models (LPIS & CADASTRE).In Chapter 5, the pilot implementation of the model of the Cadastral LPIS is described, which was held in a rural Greek area (the main criterion of this choice was the fact that there was a Cadastre there), with the help of a GIS package. The Descriptive Database of the Cadastral LPIS includes the relational model of the Cadastral LPIS in accordance with the entity-relationship model designed in this thesis, whereas additional tables have been 'incorporated', provided by the Cadastre S.A. The Spatial Database of the Cadastral LPIS (Geodatabase), was based on the existing spatial database administered by the Cadastre SA, which was further processed and enriched with the data concerning the cultivated land (parcels). The cases particularly analyzed are those where the cultivated land declared belongs to each one of the land parcel categories, i.e. the parcel is a Cadastral Sub-Parcel, a Cadastral Multi-Parcel or a Cadastral Parcel. The 6th chapter outlines the international standards of the LCM and LADM models and the design of the Greek Land Administration Domain Model (GR_LADM)). Specifically, with respect to the model LADM (ISO 19152) and the Cadastral LPIS, it was found that two data models include elements of a similar form, structure and data, which renders their direct and indirect association possible. For the first time in the case of Greece an attempt was made to design an original Greek Land Administration Domain Model (GR_LADM)) based on the international standard ISO 19152. Additionally, what is shown through the two registers correlation described above is that an original association of the LPIS models of the EU member countries with their corresponding Cadastral systems is made. The "key" to the 'cooperation' between the two models lies in the connection between a Cadastral Parcel and a Reference Parcel, which varies from country to country. This connection is made with the assistance of the two cadastral terms of the Cadastral Sub-Parcel and the Cadastral Multi-Parcel Finally, in the 7th chapter international trends are presented as well as the conclusions of this research on agricultural land registration and on the creation of the Cadastral LPIS at both a national and a European level.Η διδακτορική διατριβή με θέμα «Σχεδιασμός και Ανάπτυξη ενός Συστήματος Αναγνώρισης Γεωτεμαχίων με βάση Κτηματολογικές και Γεωργικές Καταγραφές» πραγματοποιήθηκε στον Τομέα Κτηματολογίου, Φωτογραμμετρίας και Χαρτογραφίας του Τμήματος Αγρονόμων και Τοπογράφων Μηχανικών της Πολυτεχνικής Σχολής του Αριστοτελείου Πανεπιστημίου Θεσσαλονίκης με υπεύθυνο επίβλεψης τον Καθηγητή του Τμήματος Αγρονόμων και Τοπογράφων Μηχανικών Α.Π.Θ., κ. Απόστολο Αρβανίτη.Το ζήτημα που προσεγγίζει η παρούσα διατριβή αφορά στη δημιουργία ενός Συστήματος Διαχείρισης Αγροτικής Γης το οποίο δομείται λαμβάνοντας υπόψη διεθνή πρότυπα και Κανονισμούς με στόχο να μπορεί να λάβει το ρόλο ενός ευρύτερου Συστήματος Διαχείρισης Πληροφοριών Γης.Η αναγκαιότητα του συγκεκριμένου συστήματος επιβάλλεται από τον Κανονισμό με αριθ. 1593/2000 του Συμβουλίου της Ευρωπαϊκής Ένωσης, σε ευρωπαϊκό επίπεδο, όπου αναφέρεται ότι είναι υποχρεωτική (με έτος έναρξης το 2005) η δημιουργία ενός συστήματος αναγνώρισης αγροτεμαχίων βάσει χαρτών ή εγγράφων του κτηματολογίου ή άλλων χαρτογραφικών αναφορών στο οποίο θα γίνεται χρήση τεχνικών ηλεκτρονικού συστήματος γεωγραφικών πληροφοριών.Αν και όλες οι Χώρες-Μέλη της Ε.Ε. έχουν προχωρήσει στη δημιουργία αντίστοιχων συστημάτων πληροφοριών, παραμένουν ακόμη άλυτα πολλά ζητήματα που αφορούν κυρίως σε θέματα ακρίβειας και αξιοπιστίας των συστημάτων αυτών. Δεν είναι λίγες οι περιπτώσεις που έπειτα από ανάλογους ελέγχους του Ελεγκτικού Συνεδρίου, καταγράφονται προβλήματα στα μητρώα των παραπάνω συστημάτων και τα οποία αφορούν σχεδόν σε όλες τις Χώρες-Μέλη.Ομοίως και για την περίπτωση της Ελλάδας, σήμερα (έτος 2014) δεν υπάρχει αξιόπιστο σύστημα που να καταγράφει και να διαχειρίζεται την αγροτική περιουσία. Ελλείψει του συγκεκριμένου συστήματος η Ελλάδα αδυνατεί να σχεδιάσει την παραγωγή της μέσω ενός αγροτικού κτηματολογίου καθώς και να ανταποκριθεί στις απαιτήσεις που ορίζουν οι Ευρωπαϊκές επιταγές αναφορικά με τις επιδοτήσεις καλλιεργειών που λαμβάνει κάθε έτος και για τις οποίες εκ των υστέρων πληρώνει υπέρογκα ποσά προστίμων λόγω μη-συμμόρφωσης με τους απαιτούμενους όρους. Στο πλαίσιο της αναγκαιότητας ενός αξιόπιστου συστήματος διαχείρισης αγροτικής γης και λαμβάνοντας υπόψη ότι σήμερα τηρούνται σε όλες τις χώρες συστήματα πληροφοριών που αφορούν σε αγροτικά μητρώα (όπως είναι το LPIS) καθώς και σε κτηματολογικά μητρώα (Κτηματολόγιο) ―δηλ. συστήματα χωρικών δεδομένων που περιέχουν την ίδια πληροφορία και μάλιστα με την ίδια μορφή― τίθεται το ζήτημα της συσχέτισης ή της συγχώνευσης των δύο αυτών συστημάτων. Σε μια τέτοια συσχέτιση μητρώων όχι μόνο μειώνεται το κόστος και ο χρόνος που δημιουργούσε η ταυτόχρονη ύπαρξη, συντήρηση και ενημέρωση, αλλά δίνεται και η δυνατότητα δημιουργίας ενός πολυδιάστατου συστήματος Γεωπληροφοριών. Στόχος είναι η αύξηση της ποιότητας της πληροφορίας μέσω της προτυποποίησης των δεδομένων, έτσι ώστε να βελτιωθεί ο τρόπος αναγνώρισης των αγροτεμαχίων. Αν και τα δύο αυτά συστήματα δείχνουν να είναι «όμοια», πολλά είναι τα προβλήματα που εμφανίζονται και τα οποία δυσχεραίνουν την άμεση σύνδεση τους.Τα ερωτήματα λοιπόν που τίθενται και διερευνώνται στην παρούσα διδακτορική διατριβή είναι τα εξής:1.Είναι απαραίτητη η ύπαρξη δύο παράλληλων και όμοιων συστημάτων καταγραφής γης (Ε.Κ. και Σ.Α.Α.); Πρέπει και μπορούν τα δύο αυτά συστήματα να συγχωνευθούν; Χρειάζεται κάποιο από τα δύο να καταργηθεί; Αν ναι, με βάση ποιές προϋποθέσεις πρέπει να γίνουν όλα τα παραπάνω;2.Σε συνέχεια του παραπάνω ερωτήματος και στη βάση της λειτουργίας ενός σύγχρονου συστήματος αναγνώρισης αγροτεμαχίων, με κτηματολογικές και γεωργικές καταγραφές γης, ποιός είναι ο βέλτιστος τρόπος διαχείρισης του συστήματος ώστε να μην πραγματοποιούνται επιτόπιοι έλεγχοι για εμβαδομετρήσεις εκτάσεων;3.Γιατί στις υπόλοιπες Ευρωπαϊκές Χώρες δεν έχει ήδη γίνει ομογενοποίηση αυτών των στοιχείων με δεδομένη την ύπαρξη Κτηματολογίου από πολύ πιο νωρίς σε σχέση με την Ελλάδα;Για όλους αυτούς τους λόγους, στην παρούσα διατριβή αντιμετωπίζεται το θέμα του σχεδιασμού και της δημιουργίας ενός μοντέλου συστήματος αναγνώρισης γεωτεμαχίων λαμβάνοντας υπόψη τα συστήματα αφενός των γεωργικών μητρώων αφετέρου των κτηματολογικών καταγραφών. Διερευνάται η δημιουργία ενός μοντέλου συστήματος αναγνώρισης Γεωτεμαχίων το οποίο θα μπορεί να λάβει το ρόλο ενός συστήματος Διαχείρισης της Γης. Μέσω του συγκεκριμένου μοντέλου πραγματοποιείται μια πρωτότυπη συσχέτιση των μοντέλων LPIS (Land Parcel Identification System) των Χωρών-Μελών της Ευρωπαϊκής Ένωσης με τα αντίστοιχα Κτηματολογικά τους συστήματα. Επιπλέον, επιχειρείται η δημιουργία ενός πρωτότυπου Ελληνικού Μοντέλου Διαχείρισης Γης (GR_LADM) που βασίζεται στη συσχέτιση του εν λόγω μοντέλου με το μοντέλο Land Administration Domain Model (LADM, ISO19152). Η συσχέτιση αυτή πραγματοποιείται με γνώμονα τα χαρακτηριστικά για την περίπτωση της Ελλάδας, επειδή το γενικότερο πλαίσιο του LADM δεν παρέχει τις σχέσεις και τα γνωρίσματα για λύσεις που αφορούν σε περιπτώσεις εξειδικευμένων μοντέλων ή σε περιπτώσεις χαρακτηριστικών γνωρισμάτων Χωρών.Το σύστημα αναγνώρισης γεωτεμαχίων (εφεξής αποκαλούμενο Κτηματολογικό Σ.Α.Α.) χρησιμοποιεί ως βάση αναφοράς, το μοντέλο που θα προκύψει από τη σύνδεση του Ελληνικού Κτηματολογίου και του Ελληνικού Συστήματος Αναγνώρισης Αγροτεμαχίων. Σχεδιάστηκε βάσει των Τεχνικών Προδιαγραφών του Εθνικού Κτηματολογίου, του Ελληνικού Συστήματος Αναγνώρισης Αγροτεμαχίων, του μοντέλου LPIS Core Conceptual Model (LCM), του μοντέλου Land Administration Domain Model (LADM, ISO 19152) και της αντίστοιχης Ελληνικής και Ευρωπαϊκής νομοθεσίας. Ταυτόχρονα, προτείνεται η σύνδεση του κτηματολογικού γεωτεμαχίου με τις έννοιες του κτηματολογικού υπο-Γεωτεμαχίου (το οποίο ήδη χρησιμοποιείται με ανάλογο τρόπο ως χωρική μονάδα αναφοράς σε αντίστοιχα μητρώα καταγραφών διεθνώς) και του κτηματολογικού πολυ-Γεωτεμαχίου (το οποίο αποτελεί νέο όρο -της παρούσας διατριβής- απόδοσης χωρικής μονάδας).Για την πρακτική εφαρμογή τα δεδομένα που χρησιμοποιήθηκαν είναι ο Κτηματολογικός Χάρτης της αγροτικής περιοχής της Δημοτικής Ενότητας Νέας Αγχιάλου του Δήμου Βόλου της Περιφερειακής Ενότητας Μαγνησίας σε ψηφιακή μορφή, η ψηφιακή ορθοφωτογραφία της συγκεκριμένης περιοχής και τμήμα της Περιγραφικής Βάσης Δεδομένων του Εθνικού Κτηματολογίου για την ίδια περιοχή.Αναλυτικότερα, η δομή της διδακτορικής διατριβής είναι:Αρχικά, παρουσιάζεται το Σύστημα Αναγνώρισης Αγροτεμαχίων (Σ.Α.Α.) και η παρούσα κατάσταση του στην Ελλάδα. Το Σύστημα Αναγνώρισης Αγροτεμαχίων (Σ.Α.Α.) αποτελεί ένα από τα κύρια στοιχεία του Ολοκληρωμένου Συστήματος Διαχείρισης καθώς επιτρέπει την αναγνώριση, τον εντοπισμό και τη μέτρηση των αγροτεμαχίων. Σύμφωνα με τον Καν. 1146/2010 της Επιτροπής της Ευρωπαϊκής Ένωσης, αποτελεί βασικό στοιχείο στη διαδικασία εξασφάλισης ορθών πληρωμών στους γεωργούς και διασφάλισης των πόρων της Ένωσης. Είναι η μοναδική διασφάλιση του Ολοκληρωμένου Συστήματος Διαχείρισης της ΚΑΠ, ότι η καταβολή ενίσχυσης βάσει της έκτασης πραγματοποιείται σε επιλέξιμη έκταση και σε έναν και μόνο δικαιούχο για το ίδιο αγροτεμάχιο. Στην Ελλάδα εφαρμόζεται από την 1η Ιανουαρίου 2006 στο πλαίσιο της νέας ΚΑΠ και διαθέτει από την 1η Ιανουαρίου 2009 χαρτογραφικό υπόβαθρο που δημιουργήθηκε από δορυφορικές εικόνες των ετών 2007 και 2008. Τα στοιχεία της Χωρικής του βάσης δεδομένων περιλαμβάνουν όλα τα χωρικά δεδομένα που περιγράφονται στην Ενιαία Αίτηση Ενίσχυσης και αποδίδονται σε ψηφιακό χάρτη με θεματικά επίπεδα (layers) (ΟΠΕΚΕΠΕ, 2013). Τα περιγραφικά του στοιχεία αποτελούνται από όλα τα στοιχεία που αφορούν στην ταυτότητα του παραγωγού-αγρότη και των αγροτεμαχίων που δηλώνονται στην Ενιαία Αίτηση Ενίσχυσης. Στη συνέχεια, σ
