Regarding judicial settlements, the Chilean justice system is subject to contradiction. On the one hand, in civil justice matters judicial settlements are statistically insignificant, while in labor and family matters their use is prevalent. On the other hand, comparative procedural law shows that judicial settlements progressively are having a more relevant role, generating an important discussion regarding settlement culture. None of the above happens in Chile’s civil procedure law, still this has not prevented the Chilean lawmakers to recently reform the civil procedure code, introducing new rule 3 bis, which ignoring this lack of discussion established a general duty for all legal actors to promote negotiated alternatives to procedure, ...
