IMPLEMENTASI PASAL 15 AYAT (5) PERATURAN DAERAH KOTA BATU NO 4 TAHUN 2011 TENTANG IZIN MENDIRIKAN BANGUNAN (STUDI DI DINAS PENANAMAN MODAL DAN PELAYANAN TERPADU SATU PINTU KOTA BATU)

The rapid development of the tourism industry in Batu City has an impact on the rise of changes in the function of buildings that are not in accordance with their designation. This is contrary to Article 15 paragraph (5) of Batu City Regional Regulation No. 4 of 2011 concerning IMB regarding changes in the function and classification of buildings followed by compliance with administrative and technical requirements of buildings. The formulation of the problem in this study, the first is the implementation of Article 15 paragraph (5) of Batu City Regional Regulation Number 4 of 2011 concerning Building Construction Permits, secondly the obstacles or obstacles encountered in implementing the implementation of Article 15 paragraph (5) of Batu City Regional Regulation Number 4 of 2011 Concerning Building Permit, the three attempts made in implementing implementation of Article 15 paragraph (5) of Batu City Regional Regulation Number 4 of 2011 concerning Building Permit. In order to answer these problems, this study uses a research method with a sociological juridical approach, with data collection techniques using interviews, observation and documentation and analyzed descriptively qualitatively. The results and discussion of this study indicate that the rule of law has not been implemented properly which is influenced by law enforcement factors that have not worked optimally and community factors that do not obey the rule of law. Obstacles in implementation are influenced by two factors namely, internal factors such as lack of supervision and socialization that are not optimal, while external factors come from the lack of public understanding of IMB licensing reporting.
