The Concept of indirect discrimination: its delimitation and application in European and Spanish Social Law

A pesar de que la prohibición de discriminación indirecta es un principio jurídico arraigado en nuestro ordenamiento jurídico, no se ha conseguido erradicar de nuestro sistema de relaciones laborales los efectos de este tipo de conductas que dificultan la consecución de una verdadera igualdad de oportunidades entre trabajadores y trabajadoras no solo en el mercado laboral sino en la sociedad en general. Es por ello que es necesario realizar un estudio de cómo se está llevando a cabo su aplicación por parte del Tribunal de Justicia de la Unión Europea y los Tribunales Españoles.Despite of the fact that the prohibition of indirect discrimination is a legal principle in our legal system, it has not been possible to eradicate from our labor relations system the effects of this type of behavior that prevents the achievement of true equality of opportunities between women and men not only in the labor market but in society in general. That is why it is necessary to study how its application is being carried out by the Court of Justice of the European Union and the Spanish Courts
