The Legal Protection of Consumer with a Focus on Unfair Commercial Practices

Consumer protection is starting to be more and more important today because ordinary customer has to deal with lot of different kinds of illegal commercial activities. The goal of this bachelor thesis has been to describe common illegal commercial practices and the way how can consumer protect himself from them. Author's effort was to contribute to the awareness of consumers and therefore to improve their protection. Thesis introduced in detail the issue of consumer protection, statutes of the Czech Republic and directives of the European Union connected to this topic and also concrete cases of unfair commercial practices and particular legal cases. The surmise of this bachelor thesis has been that the statutes of the Czech Republic and norms of the European Union protect consumers adequately, but that consumer himself is not sufficiently informed. This surmise has been proved by an analysis of current Czech and EU measures. Conclusion of this bachelor thesis therefore is, that responsible Czech and EU authorities should focus more on the education of consumers, because their awareness is the key part of the consumer protection against unfair commercial practices.Ochrana spotřebitele je tématem, které je v současné době stále aktuálnější, neboť běžný zákazník se musí potýkat s celou řadou případů nezákonného jednání ze strany podnikatelů. Cílem této bakalářské práce proto bylo přiblížit, s jakými protiprávními obchodními praktikami se lze setkat, a jak je možné se proti nim bránit. Snahou autorky bylo touto prací přispět k větší informovanosti spotřebitele a tím zvýšit jeho ochranu. Za tímto účelem byla podrobně představena problematika ochrany spotřebitele, zákony České republiky a směrnice Evropské unie věnující se tomuto tématu, i konkrétní případy nekalých obchodních praktik a následných soudních sporů. Tezí této bakalářské práce bylo, že zákony České republiky i normy Evropské unie chrání spotřebitele dostatečně, avšak spotřebitel sám o nich není dostatečně informován. Teze byla analýzou současného stavu ochrany spotřebitele v ČR a EU potvrzena. Závěrem této práce proto je, že by odpovědné české a unijní orgány měly věnovat více pozornosti vzdělávání spotřebitelů, neboť informovanost je podstatnou součástí ochrany spotřebitele proti nekalým obchodním praktikám
