Potensi Konflik atas Berlakunya Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja

ABSTRACT This research is entitled “Potential Conflict over the Enactment of Law Number 11 of 2020 concerning Job Creation (Study on Labor Unions in Palembang City). The purpose of the research is to find out the potential for conflict over the enactment of Law No. 11 of 2020 concerning job creation in the city of Palembang. The research method used is descriptive qualitative. Data collection techniques are interviews and documentation. The primary data source from the study was through interviews with the office of the Branch Management Board of the Federation of Trade Unions (DPC FSB NIKEUBA) Palembang City. The result of the research is that the enactment of Law No. 11 of 2020 concerning job creation turned out to cause conflict for labor workers and very detrimental to labor workers. So that the status of the work copyright law is now conditionally unconstitutional, but if you want it to be constitutional it must be corrected within two years. However, if within two years there is no improvement, it will become permanently unconstitutional, meaning that the law is null and void. Tujuan dari penelitian yaitu untuk mengetahui potensi konflik atas berlakunya undang-undang nomor 11 tahun 2020 tentang cipta kerja di kota palembang. Metode penelitian yang digunakan adalah deskriptif kualitatif. Teknik pengumpulan data adalah dengan wawancara dan dokumentasi. Sumber data primer dari penelitian melalui wawancara dengan kantor Dewan Pengurus Cabang Federasi Serikat Buruh (DPC FSB NIKEUBA) Kota Palembang. Hasil dari penelitian adalah atas berlakunya undang-undang No 11 tahun 2020 tentang cipta kerja ini ternyata menimbulkan konflik bagi pekerja buruh dan juga sangat merugikan bagi pekerja buruh. Sehingga status undang-undang cipta kerja tersebut sekarang inskonstitusional bersyarat, akan tetapi jika ingin menjadi konstitusional maka harus diperbaiki dalam jangka dua tahun. Tetapi jika dalam jangka dua tahun tidak ada perbaikan maka menjadi inskonstitusional permanen artinya batal demi hukum undang-undang tersebut.    Kata Kunci : Potensi, Konflik, Undang-undang Tentang Cipta Kerja, Buru
