La reforma de segunda generación del mercado laboral: Incentivos al «espíritu emprendedor» y retorno del «pensamiento mágico»

The RDL 4/2013, February 22, measures to promote employment and self-employment for young people take part of a true diagnosis: «youth unemployment» in Spain is a «structural problem», that if the crisis deepens, but in absolute terms creates, unlike what happens in other European countries –Italy, Sweden– where youth unemployment triplicate overall unemployment. A structural problem can be solved only with structural reforms. The new rule is intended to generate the belief that this is something it is going to do, so it tries to uncheck the Law 3/2012, dubbing it «second-generation reform», as if the name you would in itself the magic to change the reality. But, as often happens with everything that implies «second parties», once again the «promised paradise» in the preamble does not correspond with the given reality. On the contrary, compared to the illusion of an institutional framework for a new era cultural and socio-economic, more evolved and modern, based on business innovation and the youth qualification, we found the disappointment of the eternal return to the solutions of the past, reaffirming the business culture of the favour by the temporary hiring. It does not encourage entrepreneurship but the self-employed, and is not advocating more and better opportunities for youth employment, but that opens a wide range of sub-modalities labour contracts of all kinds, whose raison d'être is unique and the same: insert in the labour market to young people during a certain time, in hopes of change in the economic cycle. With this perspective, here is a detailed study of each and every one of the incentives contained in the RDL 4/2013 both to the self-employment among young people as regards to the recruitment of young people. The authors expose the new conditions of use and the problems are detected applicative, providing solutions. There is also space for a new type of recruitment of intergenerational solidarity in which it is the young entrepreneur which offers the opportunity of employment to the mature worker, with what connects also with the RDL 5/2013.El Real Decreto-ley 4/2013, de 22 de febrero, de medidas para fomentar el empleo y el autoempleo juvenil parte de un diagnóstico cierto: el «desempleo juvenil» en España es un «problema estructural», que la crisis agrava sí, pero en absoluto crea, a diferencia de lo que sucede en otros países europeos –Italia, Suecia–, en los que el desempleo juvenil triplica el desempleo global. Un problema estructural solo puede resolverse con reformas estructurales. La nueva norma pretende generar la creencia en que así lo va a hacer, por eso intenta desmarcarla de la Ley 3/2012, llamándola «reforma de segunda generación», como si el nombre tuviera en sí mismo la magia de cambiar la realidad. Ahora, sugiere, no promoverá la «devaluación» de condiciones de empleo y de trabajo para favorecer la competitividad, sino que la busca fomentando el «espíritu emprendedor», facilitando financiación alternativa a las pymes, propiciando el emprendimiento y facilitando nuevas oportunidades de empleo a los jóvenes, anticipando para España la propuesta comunitaria de la «garantía juvenil de empleo». Pero como suele suceder con todo lo que implica «segundas partes», una vez más el «paraíso prometido» en el Preámbulo no se corresponde con la realidad dada. Al contrario, frente a la ilusión de un marco institucional para una nueva era cultural y socio-económica, más evolucionada y moderna, basada en la innovación empresarial y la cualificación juvenil, encontramos la decepción del eterno retorno a las soluciones del pasado, reafirmando la cultura empresarial del favor por la contratación temporal. No se fomenta el emprendimiento –la iniciativa empresarial– sino el autoempleo, y no se propician mayores y mejores oportunidades de empleo juvenil, sino que se abre un gran abanico de sub-modalidades de contratos laborales, de todo tipo, cuya razón de ser es única y la misma: insertar en el mercado de trabajo a los jóvenes durante un cierto tiempo, en espera del cambio de ciclo económico. Con esta perspectiva, aquí se ofrece un estudio detallado de todos y cada uno de los incentivos contenidos en el Real Decreto-ley 4/2013 tanto al autoempleo juvenil cuanto a la contratación laboral de jóvenes. Los autores exponen las nuevas condiciones de uso y se detectan los problemas aplicativos, aportando soluciones. También hay espacio para una nueva modalidad de contratación de solidaridad intergeneracional en la que es el joven emprendedor el que ofrece la oportunidad de empleo al trabajador maduro, con lo que conecta también con el Real Decreto-ley 5/2013
