De empresarios a emprendedores: la resiliencia corporativa a través de la devastación de los derechos laborales

The recent labour reforms have not only led to a significant lowering of protection standards for workers, but have also modified defining structural principles of wage labour in Spain, which have traditionally been insurmountable margins for the exercise of power management; specifically, legislation have proceeded to inadequate translation of the enterprise risk to workers in situations such as dismissal or significant changes of the labour contract. The third axis of this process, the reform of the collective bargaining system, dismantles collectively agreed guarantees, thereby reducing the capacity and role of collective bargaining and union representatives of workers. Simultaneously, there has been an articulated speech on promoting the entrepreneur, which originated in EU guidelines, sustains an inconsistent, inaccurate and counterproductive development legislation for the generation of a stable and sustainable business sector policy development, and in any case it is unjustifiable as an engine of policy reforms.Las recientes reformas laborales no solo han provocado una significativa rebaja de los estándares de protección para los trabajadores y las trabajadoras, además han modificado principios estructurales definitorios del trabajo asalariado en España que tradicionalmente han constituido márgenes infranqueables para el ejercicio del poder de dirección; concretamente, se ha procedido a una traslación inadecuada de la ajenidad en los riesgos al trabajador en situaciones como el despido o las modificaciones sustanciales del contrato de trabajo. Como tercer eje de este proceso, la reforma de la negociación colectiva desmantela el sistema de garantías colectivamente pactadas, reduciendo de este modo la capacidad y el papel de representantes colectivos y sindicales de los trabajadores. Paralelamente se ha articulado un discurso relativo al fomento de la figura del emprendedor que, con origen en directrices comunitarias, se está sustentando en un desarrollo normativo incongruente, impreciso y contraproducente para la generación de un tejido empresarial estable y sostenible, y en todo caso pretextado injustificadamente como motor de las reformas normativas
