O ABUSO DE AUTORIDADE POR USO INDEVIDO DE ALGEMAS NA PRISÃO EM FLAGRANTE

This paper analyzes the abuse of authority by the undue use of handcuffs in detentions in flagrante delicto. It is used the deductive method to tackle the use of handcuffs as practice of abuse of authority, essentially in red-handed situations. To do so, an analysis of the state’s instruments that regulate the use of the apparatus is made, as well as considerations about the state’s police power and the limits of the state agent. Notions about the requirements and forms of the detention in flagrante delicto are presented, as well as the characterization of the abuse of authority by the undue use of handcuffs. This situation results in a serious threat to the fundamental rights of the human being, essentially in the matter of the violation of its physical integrity. In conclusion, when the state agent acts in excess, using handcuffs in a undue way, causing bodily injury, it is a case of abuse of authority, and the arrestee must be released by the judge of competent jurisdiction.O presente artigo analisa o abuso de autoridade pelo uso de algemas no momento da prisão em flagrante. Utiliza-se do método dedutivo para abordar o uso de algemas como prática de abuso de autoridade, essencialmente na situação de flagrância. Para tanto, faz-se uma análise dos instrumentos estatais que preveem a utilização do aparato. Para isso, são tecidas considerações acerca do poder de polícia do Estado e os limites do agente estatal. São apresentadas noções acerca dos requisitos e modalidades da prisão em flagrante, bem como a caracterização de abuso de autoridade pelo uso indevido de algemas. Essa situação resulta grave afronta aos direitos fundamentais da pessoa humana, essencialmente ao que diz respeito à violação da integridade física do sujeito. Conclui-se que quando o agente estatal age com excesso, utilizando as algemas de forma indevida, causando lesão corporal, é caso de abuso de autoridade, devendo a prisão em flagrante ser relaxada pelo juiz competente
