Buscando boas meninas - um estudo das justificações dadas por adolescentes que infringiram leis

Teenagers who break the law in Brazil are summoned to explain to in the Court, the reasons for their actions. They use certain elements, speeches and logics to persuadethe audience - especially the Judge - that the transgressions they were involved intohave legitimated motivations. The present article studies such Justification assembledby girls who broke the law in São Gonçalo, a municipality in the province of Rio deJaneiro. Our main objective is to demonstrate how the Court’s decision depends onevidences raised by the youth. Cases held in the Court of Children and Youth of thecity were analyzed. The documents highlight the discourse as well as other elementsand objects the commission raised during the trials. Confronting both ways of (re-) construction of facts and versions it’s possible to understand the forms oflegitimization of each Justification process and which role they play in determiningthe socio-educational sentence applied to the girls.Os adolescentes que infringem as leis no Brasil são convocados a explicar, perante o Juiz, em audiência, os motivos de seus atos. Visando justificar-se, tais adolescentes lançam mão de certos elementos, discursos e lógicas para convencer os presentes de que os atos infracionais possuem circunstâncias e motivações legítimas. Este artigo dedica-se ao estudo das Justificações dadas por meninas que infringiram as leis em São Gonçalo, Rio de Janeiro, e da forma como as provas sociológicas levantadas por estas interferem na sentença proferida pela Juíza. Para tal foram analisados processos abertos no Juizado da Infância e da Juventude da cidade citada, e por meio destes pôde-se observar as falas, os elementos e objetos levantados na provação do cometimento dos atos infracionais; aíém de observada a possibilidade de legitimação das Justificações e de como estas têm parte fundamental na determinação da medida sócio-educativa
