Execução das medidas socieducativas na proteção das crianças e dos adolescentes

This work was conducted through a bibliographical research, focusing on the subject of the execution of socio - educational measure in the protection of children and adolescents: application and perceptive in Brazilian legal order. The basic question for the development of the study was: What are the penalties for children and adolescents who commit an infraction in our legal system? The general objective of this was to verify the legal support dedicated in the execution of the socio-educational measure to the child and the adolescent in our country. It presents the historical legislative and conceptual evolution of the child and adolescent in Brazil and in the legal system, explaining what is an infraction, what is the procedure in case these acts are practiced and how the enforcement of such measures is given. We present the definition of what socio-educational measures are, which are they, which can be applied to the child and to the adolescent. In addition, it addresses the protection of children and adolescents in the implementation of socio-educational measures and the possibility of unification and exemption from compliance. The present work allowed the understanding of the great evolution in the course of the history of the child and the adolescent in Brazil, with the doctrine of integral protection and recognition as a person in a situation of development and no longer as they were previously treated, unprotected by specific legislation. The socioeducational measures give all care so that they are applied to the child in an equivalent way to the act committed and in a way that does not harm him, according to each case. It is of the utmost importance to analyze the issue in question, since it has been causing several discussions among law operatives. A multidisciplinary discussion on the subject is needed to adapt legislation to new times and contexts, reducing the sense of impunity and guaranteeing a decent future for future generations, while protecting the current crime and marginalization.Este trabalho foi conduzido por meio de pesquisa bibliográfica, com foco no tema da execução de medida socioeducativa na proteção da criança e do adolescente: aplicação e perceptiva no ordenamento jurídico brasileiro. O questionamento base para o desenvolvimento do estudo foi: Quais as penalidades previstas para as crianças e os adolescentes que cometem ato infracional em nosso ordenamento jurídico? O objetivo geral deste foi verificar o amparo jurídico dedicado na execução da medida socioeducativa à criança e ao adolescente em nosso país. Apresenta-se a evolução histórica legislativa e conceitual da criança e adolescente no Brasil e no ordenamento jurídico, explicando o que é ato infracional, qual é o procedimento no caso desses atos serem praticados e como se dá a execução de tais medidas. Apresenta-se a definição do que são medidas socioeducativas, quais são elas, quais podem ser aplicadas para a criança e para o adolescente. Além disso aborda-se a proteção da criança e adolescente na execução das medidas socioeducativa e a possibilidade de unificação e isenção de cumprimento. O presente trabalho permitiu a compreensão da grande evolução no decorrer da história da criança e do adolescente no Brasil, com a doutrina de proteção integral e reconhecimento como pessoa em situação de desenvolvimento e não mais como eram tratados anteriormente, desprotegidos por legislação específica. As medidas socioeducativas conferem todos os cuidados para que sejam aplicadas ao menor de maneira equivalente ao ato cometido e de maneira que não o prejudique, conforme cada caso. É de suma importância analisar o tema em questão, visto que vem causando várias discussões entre os operados do direito. Uma discussão multidisciplinar sobre o assunto se faz necessária para adequar a legislação aos novos tempos e contextos, diminuindo a sensação de impunidade e garantindo um futuro digno às futuras gerações, ao mesmo tempo que se protege a atual da criminalidade e da marginalização
