The criminal protection and the counseling of violence against women

This work, linked to the Law and Social Vulnerability research line, has as its central theme the fight against violence against women and seeks to assess the extent to which criminal protection can contribute to the fight against violence against women in Brazil. Violence against women and the numbers of this violence show us that the challenges are as great as the achievements, and that the criminalization of conduct, or worsening of sentences, or the creation of qualifiers, can give women greater protection against violence. The research seeks to study the possibility of contributing criminal protection as a mechanism to curb violence against women in Brazil. Develop the concept of this violence, present the historical process of legal-normative construction of the criminal protection of violence against women in Brazil, display the contemporary legal-normative panorama of criminal protection in the country and evaluate the potential of criminal protection to confront violence against women in the national context. For this purpose, the hypothetical-deductive approach method was used, through the construction of a conjecture (hypothesis) that will be submitted to a discussion. The techniques used were bibliographic and documentary, with emphasis on doctrinal, legislative and jurisprudential research.Sem bolsaEste trabalho, vinculado à linha de pesquisa Direito e Vulnerabilidade Social, tem como tema central o enfretamento da violência contra a mulher e busca aferir em que medida a tutela penal pode contribuir para o combate da violência contra a mulher no Brasil. A violência contra mulher e os números dessa violência demonstram que os desafios são tão grandes quanto as conquistas, que sempre foram de toda ordem e para todas as mulheres. Além disso, também demonstram que a criminalização das condutas, ou agravamento das penas, ou a criação de qualificadoras, pode conferir à mulher uma maior proteção frente à violência. Nesta pesquisa, procura-se estudar a possibilidade de contribuição da tutela penal como mecanismo para coibir a violência contra a mulher no Brasil. Além disso, esta pesquisa objetiva desenvolver o conceito dessa violência, apresentar o processo histórico de construção jurídico-normativa da tutela penal da violência contra a mulher no Brasil, exibir o panorama jurídico-normativo contemporâneo da tutela penal no país e avaliar a potencialidade da tutela penal para o enfrentamento da violência contra a mulher no contexto nacional. Para tanto, foi utilizado o método de abordagem hipotético-dedutivo, mediante a construção de uma conjectura (hipótese) que foi submetida a uma discussão.
