O papel do direito penal no combate ao homicídio por questão de gênero

The main OBJECTIVE of this paper is to analyze whether criminal law is capable of combating homicides due to gender issues. SPECIFIC OBJECTIVES are A) to analyze the crime of homicide, elementary, forms, with emphasis on the qualifier for femicide; B) study the social phenomenon of gender violence; C) examine the legitimate and illegitimate functions of criminal law; D) expose the doctrinal divergence regarding the theme and; E) evaluate the need for the typification of femicide in the Brazilian legal system. The deductive approach METHOD and the monographic and comparative procedure methods. The research is exploratory, qualitative approach and bibliographic and documentary procedures. Among the main RESULTS and CONCLUSIONS found are: A) Gender violence represents the results of a patriarchal culture rooted in all countries of the world since the beginning of civilization, this domination triggered the phenomena that are still sought to eradicate today. B) There is a cycle of violence against women, due to affective and intrafamily relationships that precede feminicide and is not perceived by society, and, primarily, by the public power and its agents, lack of expertise and neglect to dealing with cases of domestic violence contribute to the increase in femicide cases. C) Criminal Law is not an instrument capable of resolving cases of femicide, corresponding in such cases to legislation that performs symbolic functions. D) The symbolic function promoted by femicide, allows the accounting of cases and unification of all sectors capable of promoting a study of each case and the situations of violence faced by the victim, bringing visibility to the problem, forcing the state to invest in public policies. prevention of domestic violence so as not to increase the rates of femicide.O OBJETIVO principal deste trabalho é analisar se o Direito Penal é capaz de combater os homicídios por questões de gênero. Os OBJETIVOS ESPECÍFICOS são A) analisar o crime de homicídio, elementares, formas, com ênfase na qualificadora por Feminicídio; B) estudar o fenômeno social da violência de gênero; C) examinar as funções legítimas e ilegítimas do Direito Penal; D) expor a divergência doutrinária referente à temática e; E) avaliar a necessidade da tipificação do Feminicídio no ordenamento jurídico brasileiro. O MÉTODO de abordagem foi o dedutivo e os métodos de procedimento monográfico e comparativo. A pesquisa é de nível exploratório, de abordagem qualitativa e de procedimentos bibliográfico e documental. Dentre os principais RESULTADOS e CONCLUSÕES encontrados, ressaltam-se: A) A violência de gênero representa os resultados de uma cultura patriarcal enraizada em todos os países do mundo desde o início da civilização, esta dominação desencadeou os fenômenos que se buscam erradicar ainda hoje. B) Existe um ciclo de violência contra a mulher em decorrência de relações afetivas e intrafamiliares que precedem o Feminicídio e que não é percebido pela sociedade, e, em primordial, pelo poder público e seus agentes, a falta de perícia e a negligência ao lidar com os casos de violência doméstica contribuem para o aumento dos casos de Feminicídio. C) O Direito Penal não é instrumento capaz de solucionar os casos de Feminicídio, correspondendo, nestes casos, a legislação que desempenha função simbólica. D) A função simbólica promovida pelo Feminicídio permite a contabilização dos casos e unificação de todos os setores capazes de promover um estudo de cada caso e as situações de violência enfrentadas pela vítima, trazendo visibilidade ao problema, forçando o estado a investir em políticas públicas de prevenção da violência doméstica para que não ocorra o aumento das taxas de Feminicídio
