TANGGUNG JAWAB DAN PERLINDUNGAN HUKUM BAGI NOTARIS PURNA BAKTI TERHADAP AKTA YANG PERNAH DIBUAT (Analisis Pasal 65 dan Pasal 66 Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris)

Abstract Notary is a public official authorized to make an authentic deed and other authorities referred to in UUJN.Notaris responsible for every deed he had done, and be held accountable even if the notary has full devotion, it is in line with the provisions contained in Article 65 UUJN. Legal protection for Notary has been set in article 66 UUJN, but the protection of the law applies only to notaries who still menjabat.Notaris who have full service should still be responsible for the deed ever made, but the Act does not regulate legal protection for Notary who has full devotion, so in this case a vacancy occurs hukum.Penelitian aims to identify and analyze why the Notary who has full devotion remains to be responsible for the deed ever made, as well as knowing the form of legal protection Notary who has full devotion to the deed ever made , In an effort to know the responsibilities and legal protection of the Notary who has full baktii on deeds ever made, the author uses the theory of responsibility, authority theory, the theory of justice and the theory of legal protection to the type of normative juridical research, the research done by reviewing laws regulations applicable or applied to a specific legal issue. Â Key words: responsibilities and protection law, notary who has retired, article 65 and article 66 of uujn Abstrak Notaris merupakan pejabat umum yang berwenang membuat akta autentik dan kewenangan lainnya sebagaimana yang dimaksud dalam UUJN.Notaris bertanggung jawab atas setiap akta yang dibuatnya, dan dapat dimintai pertanggungjawaban walaupun Notaris tersebut telah purna bakti, hal tersebut sesuai dengan ketentuan yang terdapat dalam pasal 65 UUJN. Perlindungan hukum bagi Notaris telah diatur pada pasal 66 UUJN, namun perlindungan hukum tersebut hanya berlaku bagi notaris yang masih menjabat.Notaris yang telah purna bakti tetap harus bertanggung jawab atas akta yang pernah dibuatnya, namun Undang-Undang tidak mengatur perlindungan hukum bagi Notaris yang telah purna bakti, sehingga dalam hal ini terjadi kekosongan hukum.Penelitian ini bertujuan untuk mengetahui dan menganalisa mengapa Notaris yang telah purna bakti masih tetap harus bertanggung jawab terhadap akta yang pernah dibuat, serta mengetahui bentuk perlindungan hukum Notaris yang telah purna bakti terhadap akta yang pernah dibuat. Dalam upaya mengetahui tanggung jawab dan perlindungan hukum terhadap Notaris yang telah purna baktii atas akta yang pernah dibuatnya, penulis menggunakan teori tanggung jawab, teori kewenangan, teori keadilan dan teori perlindungan hukum dengan jenis penelitian yuridis normatif, yaitu penelitian yang dilakukan dengan mengkaji peraturan perundang-undangan yang berlaku atau diterapkan terhadap suatu permasalahan hukum tertentu. Pentingnya perlindungan hukum bagi notaris ialah menjaga keluhuran harkat dan martabat jabatannya, termasuk ketika memberikan kesaksian dan berproses dalam pemeriksaan dan persidangan, merahasiakan keterangan akta guna menjaga kepentingan para pihak yang terkait didalam akta tersebut, dan menjaga minuta atau surat-surat yang dilekatkan pada minuta akta, serta protokol notaris dalam penyimpanannya.
