Perlindungan Hukum Terhadap Notaris dalam menjalankan Tugas dan Fungsi Sebagai Pejabat Umum

Notaries as General Officials have the scope of duties of carrying out the position of a Notary, namely making evidence desired by the parties for a certain legal action, and the evidence is at the level of Civil Law, that the Notary makes a deed because there is a request from the parties who appear, without If there is a request from the parties, the notary cannot make a deed. However, in carrying out their duties and obligations, the notary often gets into legal problems because the parties provide false information or letters, which causes the notary to suffer material and immaterial losses. Therefore, this study focuses on the legal protection of notaries as public officials and the legal consequences of notary protection as public officials. The results of the study are that legal protection for notaries is contained in Article 66 paragraph 1 of the UUJN which requires Polri investigators to obtain prior permission from the Notary Regional Supervisory Council with the aim that the examination is carried out in accordance with the law. The results of the next research are that the legal consequences of Article 66 paragraph 1 UUJN, according to this article, if the Notary is proven guilty, he can be summoned before the trial and can provide information about the deed made, this makes the Notary can violate the Notary's Oath of Office regarding the Notary's obligation to keep secret the contents of the deed. Abstrak Notaris sebagai Pejabat Umum memiliki ruang lingkup tugas pelaksanaan jabatan Notaris yaitu membuat alat bukti yang diinginkan oleh para pihak untuk suatu tindakan hukum tertentu, dan alat bukti tersebut berada dalam tataran Hukum Perdata, bahwa Notaris membuat akta karena ada permintaan dari para pihak yang menghadap, tanpa ada permintaan dari para pihak maka notaris tidak dapat membuat akta. Akan tetapi dalam menjalankan tugas dan kewajibannya notaris sering mendapatkan masalah hukum karena para pihak memberikan keterangan atau surat palsu, yang menyebabkan notaris mengalamin kerugian materil dan imateril. Oleh sebab itu penelitian ini berfokus terhadap perlindungan hukum notaris sebagai pejabat umum dan Akibat Hukum perlindungan notaris sebagai pejabat umum. Hasil dari penelitian yaitu bahwa perlindungan hukum terhadap notaris terdapat dalam Pasal 66 ayat 1 UUJN yang mewajibkan penyidik Polri memperoleh ijin terlebih dahulu dari Majelis Pengawas Daerah Notaris yang bertujuan agar pemeeriksaan berjalan sesuai dengan Undang-Undang. Hasil penelitian berikutrnya bahwa akibat hukum dengan adanya Pasal 66 ayat 1 UUJN maka sesuai Pasal ini jika Notaris terbukti bersalah maka dapat di panggil di muka persidangakn serta dapat memberi keterangan mengenai akta yang dibuat hal ini menjadikan notaris dapat melanggar Sumpah Jabatan Notaris mengenai kewajiban Notaris untuk merahasiakan isi akta
