ANALISIS YURIDIS TERHADAP AKTA NOTARIS YANG DICATAT DALAM SELA-SELA KOSONG DI ANTARA AKTA NOTARIS YANG TELAH DICATAT DALAM BUKU DAFTAR AKTA NOTARIS

Sehingga pelaksanaan tugas jabatan notaris tersebut perlu diawasi. Akta yang dicatat dalam sela-sela kosong di antara akta notaris yang telah dicatat dalam buku daftar akta akan memiliki kekuatan pembuktian sebagai akta di bawah tangan karena tidak terpenuhinya syarat formil dan batal demi hukum karena mengandung unsur penipuan. Akibatnya notaris harus mempertanggungjawabkannya dengan memenuhi sanksi perdata, Sanksi administrasi dan Sanksi pidana. Jurnal ini disusun dengan metode penelitian yuridis normatif dengan pendekatan perundang-undangan. Berdasarkan hasil penelitian diketahui terdapat akibat yang sangat berbahaya apabila notaris membuat akta dan mencatat akta tersebut dalam sela-sela kosong di antara akta yang telah dicatat dalam buku daftar akta notaris. Selain status hukum dari akta tersebut terdegradasi menjadi akta di bawah tangan dan batal demi hukum sehingga tidak dapat menjadi alat bukti yang sempurna, pembuatan akta tersebut juga bertentangan dengan kewajiban notaris yang tertuang dalam Pasal 15 UU Nomor 2 Tahun 2014 yaitu notaris harus menjamin kepastian tanggal dan waktu.
