Este fallo del TJUE constituye el último desarrollo dirigido a interpretar la novedad introducida por el Tratado de Lisboa en el art. 263, párrafo cuarto, del TFUE, con el objetivo de garantizar que los particulares no se vean obligados a infringir la ley para tener acceso a un tribunal.
