El TJUE pierde el rumbo en el dictamen 2/13: ¿merece todavía la pena la adhesión de la UE al CEDH?

On 18 December 2014 the CJEU issued Opinion 2/13 in which, on reply to the request for interpretation filed by the Commission in accordance with Article 218(11) TFEU, it ruled that the Draft Accession Agreement of the EU to the ECHR is not compatible with Article 6(2) TEU nor with Protocol no. 8 TEU. This incompatibility derives from five fundamental elements, namely, the specific characters and the principle of autonomy of EU law, the scope of Article 344 TFEU, the role of co-defendant, the prior intervention mechanism of the CJEU and judicial review of CFSP. The Court of Justice, departing from AG Kokott's opinion, opts for such an extensive interpretation of the principle of autonomy of EU law that renders accession almost impossible. This ruling of the ECJ deserves very negative criticism. Not only it impedes accession of the EU to the ECHR in the terms negotiated in the Draft Agreement, this Opinion is likely to negatively influence as well the judicial dialogue between the ECHR and the ECJ and with the Constitutional Courts of the Member States. It finally raises the question of whether it is still worth for the EU to continue trying to access to the ECHR. The reply to this question is not easy. However, it ultimately falls not on the CJEU, but on Member States.El 18 de diciembre de 2014 el TJUE emitió el dictamen 2/13 en el que, en respuesta a la solicitud planteada por la Comisión de acuerdo con el art. 218.11 TFUE, consideró que el Proyecto de Acuerdo de Adhesión de la UE al CEDH no es compatible con el art. 6.2 TUE ni con el Protocolo núm. 8 TUE. Esta incompatibilidad deriva de cinco elementos fundamentales, a saber, las características específicas y el principio de autonomía del Derecho de la Unión, el alcance del art. 344 TFUE, la figura del codemandado, el mecanismo de intervención previa del TJUE y el control jurisdiccional de la PESC. El Tribunal de Justicia, a diferencia de lo propuesto por la abogada general KOKOTT, opta por una interpretación tan extensiva del principio de autonomía de la Derecho de la Unión que hace realmente muy difícil la adhesión. Se trata de un pronunciamiento del TJUE que merece una valoración crítica negativa. Además de impedir la adhesión de la UE al CEDH en los términos negociados en el Proyecto de Acuerdo de Adhesión, este dictamen tendrá probablemente una incidencia también negativa en el diálogo judicial del TJUE con el TEDH y con los Tribunales Constitucionales nacionales. Plantea, a la postre, la pregunta de si todavía merece la pena seguir intentando la adhesión de la UE al CEDH. La respuesta no es sencilla, pero, en última instancia, no le corresponde darla al TJUE sino a los Estados miembros
