El Tribunal de Justicia y la supletoriedad del Derecho estatal como garantía del cumplimiento autonómico del Derecho de la Unión Europea

Commentary on the Judgment of the Court (Fifth Chamber) of 24 October 2013, European Commission/Spain, Case C-151/12. This judgment has revealed the existence of limits of EU Law to the consideration of the supplementing clause of Article 149(3) of the Spanish Constitution as a general guarantee of regional compliance of the EU Law. The Constitutional Court had already limited the use by the State of national rules in a supplementing manner requiring, on the one hand, specific powers to allow a state norm to act as supplementing the regional law and, on the other hand, considering the supplementing clause as a rule directed to the legal practitioner in the interpretation and application of law. The Court of Justice of the European Union has further limited its scope requiring compliance with the conditions of clarity and precision derived from the general principle of legal certainty.Comentario a la Sentencia del Tribunal de Justicia (Sala Quinta), de 24 de octubre de 2013, Comisión/España, C-151/12. Esta sentencia ha puesto de manifiesto la existencia de límites de derecho comunitario a la consideración de la cláusula de supletoriedad del artículo 149.3 de la Constitución como garantía general del cumplimiento autonómico del derecho de la Unión Europea. El Tribunal Constitucional ya había limitado el recurso estatal a la supletoriedad exigiendo, de un lado, título habilitante competencial específico para que una norma estatal pudiera actuar como supletoria del derecho autonómico y, de otro lado, considerando la regla de la supletoriedad como una norma dirigida al operador jurídico en la interpretación y aplicación del derecho. El Tribunal de Justicia de la Unión Europea ha limitado aún más su alcance al requerir el respeto de las exigencias de claridad y precisión derivadas del principio general de la seguridad jurídica
