PERJANJIAN KAWIN SETELAH PERKAWINAN DAN AKIBAT HUKUMNYA ( THE AGREEMENT OF MARRIED AFTER MARRIAGE AND IT'S LAW EFFECT)

In order to solve the problem of the capital asset of husband-wife that have been operate during the marriage can operate its regulation through the agrement of married after marriage by State Court establishment form. Because of that if husband and wife do not make the agreement of married yet, that both of them, husband-wife have a job where their place of job have high risk of the reduction up to end of their capital asset that have been gotten, for the necessities of the solving of had problem by the attempt that they have been done, so that in order to make their future life and the education of their children, it is important to make the aggrement of married after the marriage have been done by the principle of the State Court Establisment. The Agrement of married institution more be used by husband-wive who have been done the marriage by appliyng of application of establisment to the State Court. This matter is different with the decision in Civil Code that arrange of capital asset of Marriage. This research be done in capital of East Jakarta territory by emperical yuridical approach method. This approach method be used in order to khow the application of law decision in Civil Code and laws of marriage also the rule of its execution in relation with the practice in the field and in matter of the aggrement of married in the capital of Jakarta. From the result of this research be known that the reason that be applied by the husband-wife when they making of the agreement of married is the individual characteristic reason. Finally in order to fulfill the needs of such practise be held the law alternative by applying the application of making the agreement of married to the State Court, such mater be done because the State Court as the law Institution wich have a high pride, where its law product must be obeyed by whoever. The establishment of the agreement of married from the State Court can be used as the law principle for husband â wife in order to protect the capital asset that they get during the marriage. In the other side agreement of married that made for practice in the capital of Jakarta majority about to separate of the capital asset so the are no other matery beside of the capital asset. Dalam mengatasi masalah harta kekayaan dari suami-isteri yang telah melangsungkan perkawinan, dapat melakukan pengaturannya melalui Perjanjian Kawin setelah perkawinan dengan bentuk Penetapan Pengadilan Negeri. Oleh karena itu jika ada suami-isteri belum membuat Perjanjian Kawin, yang kedua-duanya bekerja dimana tempat mereka bekerja mempunyai risiko tinggi akan habisnya harta kekayaan yang telah diperoleh, untuk keperluan penyelesaian urusan dengan usaha yang mereka jalani, maka demi masa depan kehidupan mereka dan pendidikan anak-anak mereka, diperlukan pembuatan Perjanjian Kawin setelah Perkawinan dilangsungkan dengan dasar Penetapan Pengadilan Negeri. Perkembangan lembaga Perjanjian Kawin setelah perkawinan semakin banyak dipakai oleh suami-isteri yang telah melangsungkan perkawinan, dengan cara mengajukan permohonan Penetapan ke Pengadilan Negeri . Penelitian ini dilakukan dengan metode pendekatan yuridis empiris. Metode pendekatan ini digunakan untuk mengetahui penerapan ketentuan hukum dalam Kitab Undang-undang Hukum Perdata dan UU Nomor 1 Tahun 1974 tentang Perkawinan serta peraturan pelaksanaannya dalam kaitannya dengan praktek di lapangan dalam hal pembuatan Perjanjian Kawin di Daerah Khusus Ibukota Jakarta. Dari hasil penelitian, diketahui bahwa alasan yang diajukan oleh suamiisteri pada saat membuat Perjanjian Kawin adalah alasan yang bersifat individualistis yaitu adanya kealpaan dan ketidaktahuan mereka tentang Perjanjian Kawin yang harus dibuat sebelum perkawinan, akhirnya untuk memenuhi kebutuhan dalam praktek tersebut diadakan terobosan hukum dengan cara pengajuan permohonan pembuatan Perjanjian Kawin ke Pengadilan Negeri, hal ini ditempuh karena Pengadilan Negeri sebagai instansi hukum yang dijunjung tinggi, dimana produk hukumnya harus dipatuhi oleh siapapun. Penetapan Perjanjian Kawin dari Pengadilan Negeri dapat dipakai sebagai payung hukum bagi suami-isteri untuk melindungi harta kekayaan yang mereka peroleh selama perkawinan. Di lain isi Perjanjian Kawin yang dibuat dalam praktek di Daerah Khusus Ibukota Jakarta mayoritas mengenai pemisahan harta kekayaan, sedangkan materi lain di luar harta kekayaan perkawinan tidak ada
