AKIBAT HUKUM PENGADAAN TANAH UNTUK KEPENTINGAN UMUM YANG DILAKUKAN SECARA LANGSUNG MELALUI JUAL BELI (Studi Kasus Pembelian Tanah HM Oleh Pemkab Sambas Untuk Pembangunan Gedung Kantor Pemerintah)

ABSTRACT The importance element in land supplying procedure for the public importance is the Law Certainty to give the Law Protection not only for the land right holder but also for the government. This Law Certainty is not given yet by the legislation regulations especially for the land supplying procedure which is done directly through trading therefore it made various interpretations in its practice. These various interpretations are so interesting to be researched deeply in a thesis entitled: “THE CONSEQUENCE OF LAND SUPPLYING LAW FOR THE PUBLIC IMPORTANCE WHICH IS DONE DIRECTLY THROUGH TRADING (The Case Study of Right Property Land Buying by The Sambas Government for The Government Office Building Development)”. The various interpretations above bring the problem especially for the law implementation and its effect in the field, if the given interpretation is unequal with the National Land Law system and principle, which was ever done by Sambas District Government. The aim of this research is to find out the answer of that problem. The research of this thesis is done through the juridical empiric approach by using qualitative data of analytical technique in descriptive analytical to the primary and secondary data which had gained through the interview method and literature study. Based on our research, the Government can not do on land acquisition for public purposes through the purchase of land Property because of the principle of sale held by the National Land Law. Therefore, the sale is governed by Presidential Decree No. 55 Year 1993 and Presidential Decree No. 36 of 2005 jo. Presidential Regulation No. 65 of 2006, must be translated according to the system and the applicable legal principle. While the ruling is the result null and void under Article 26 UUPA as material ineligible buying and selling of land. Sambas regency government concluded in conducting small-scale land acquisition for public purposes through the purchase and sale regardless of the material compliance buying and selling of land. The Key word : Land Supplying, Government, Trading. ABSTRAK Unsur yang penting dalam prosedur pengadaan tanah untuk kepentingan umum adalah kepastian hukum. Ini untuk memberikan perlindungan hukum bagi pemegang hak atas tanah, juga bagi Pemerintah. Kepastian hukum ini belum diberikan oleh peraturan perundang-undangan yang mengaturnya, terutama terhadap prosedur pengadaan tanah yang dilakukan secara langsung melalui jual beli, sehingga dalam prakteknya menimbulkan beragam penafsiran. Beragamnya penafsiran ini sangat menarik untuk diteliti secara mendalam dalam bentuk tesis dengan judul: “AKIBAT HUKUM PENGADAAN TANAH UNTUK KEPENTINGAN UMUM YANG DILAKUKAN SECARA LANGSUNG MELALUI JUAL BELI (Studi Kasus Pembelian Tanah HM Oleh Pemkab Sambas Untuk Pembangunan Gedung Kantor Pemerintah)”. Beragamnya penafsiran di atas menimbulkan permasalahan, terutama terhadap pelaksanaan dan akibat hukum yang ditimbulkannya di lapangan, jika tafsiran yang diberikan tidak sejalan dengan sistem dan asas Hukum Tanah Nasional, yang dalam prakteknya pernah dilakukan oleh Pemerintah Kabupaten Sambas. Tujuan penelitian ini adalah mencari jawaban dari permasalahan tersebut. Penelitian tesis ini dilakukan melalui pendekatan yuridis empiris, menggunakan teknik analisis data kualitatif yang dilakukan secara deskriptif analitis terhadap data primer dan data sekunder yang telah diperoleh melalui metode wawancara dan studi pustaka. Berdasarkan hasil penelitian, Pemerintah tidak dapat melakukan pengadaan tanah untuk kepentingan umum melalui pembelian tanah Hak Milik karena terhalang oleh asas jual beli yang dianut oleh Hukum Tanah Nasional. Oleh karena itu jual beli yang diatur oleh Keputusan Presiden Nomor 55 Tahun 1993 dan Peraturan Presiden Nomor 36 Tahun 2005 jo. Peraturan Presiden Nomor 65 Tahun 2006, harus ditafsirkan menurut sistem dan asas hukum yang berlaku. Sedangkan akibat hukumnya adalah batal demi hukum berdasarkan Pasal 26 UUPA karena tidak memenuhi syarat materiil jual beli hak atas tanah. Disimpulkan Pemerintah Kabupaten Sambas dalam melaksanakan pengadaan tanah skala kecil untuk kepentingan umum melalui jual beli dengan mengabaikan pemenuhan syarat materiil jual beli hak atas tanah.
