PELAKSANAAN KUASA MENJUAL DALAM KAITANNYA DENGAN PERJANJIAN UTANG PIUTANG DI WILAYAH JAKARTA SELATAN

The giving of authority in Indonesian positive law is regulated in Book III Chapter XVI from Article 1792 to Article 1819 of Civil Code. Today, the giving of authority is highly required, considering the continuously developed dynamic and mobility of the society. It cannot be imagined a society without a representative institution realized in all aspect of life in laws. Through a matter of representing is considered as normal in these days. The giving of authority to sell is one of authoritative certificate that are generally found in the society. The composition of authoritative certificate to sell in form of notary certificate is not a strange matter in daily notary practice. The process of giving an authority to sell certificate, following an agreement of debt and credit, needs a through juridical study, considering that the construction of law in this debt and credit agreement is that, if a debtor violates the agreement, therefore, the creditor, based on the authority to sell given to him/her will sell the object of security to take his/her full payment of his/her credit. Based on those matters, therefore, the problems that will be examined in this research are: the execution of the authority to sell related to the debt and credit agreement in its practice and the lawful protection for the giver of authority in the execution of authority to sell related to the debt and credit agreement. The used method of approach is the juridical-empirical approach and the specification used in this research is the descriptive-analytical research. Based on the research results, it can be concluded that the giving of authority to sell to guarantee the full payment to the creditor if the debtor violated the agreement cannot be executed considering that matter has a lawful risk for the involved parties, especially the giver of authority is able to sell the object(s) of security anytime whether there is any violation or not. Thus, this cannot give lawful protection and certainty. Therefore, the notary will refuse to compose an authority to sell related to an agreement of debt and credit. The authority to sell may be given to execute the object of Security Rights made by a privately-made selling agreement as regulated in the terms of Article 20 verse (2) of the law of the Republic of Indonesia Number 4 Year 1986 about Security Right upon Land. A lawful protection for the giver of authority in the composition of the authority to sell may be given if that authority to sell certificate was made in an authentic certificate, which is a perfect proof. Moreover, Article 1800-1806 of Civil Code, regulating the obligation of the recipient of authority, is a form of a lawful protection given by laws for the giver of authority. Pemberian kuasa dalam hukum positif Indonesia diatur di dalam Buku III Bab XVI mulai dari Pasal 1792 sampai dengan Pasal 1819 KUHPerdata. Pemberian kuasa pada masa sekarang ini sangatlah diperlukan, mengingat dinamika dan mobilitas anggota masyarakat yang terus berkembang. Tidak dapat dibayangkan suatu masyarakat tanpa lembaga perwakilan yang terwujud dalam segala segi kehidupan dibidang hukum. Melalui perantara seseorang dapat diwakili oleh orang lain dalam melakukan suatu perbuatan hukum. Hal mewakili dewasa ini dianggap sudah lumrah dilakukan. Pemberian kuasa untuk menjual merupakan salah satu bentuk akta kuasa yang sering dijumpai di masyarakat. Pembuatan akta kuasa menjual dalam bentuk akta notaris merupakan suatu hal yang tidak asing dalam praktek notaris sehari-hari. Pemberian kuasa jual yang mengikuti suatu perjanjian utang piutang, perlu kajian yuridis lebih lanjut, mengingat konstruksi hukum dalam perjanjian utang piutang ini adalah, apabila debitor wanprestasi, maka kreditor berdasarkan kuasa jual yang telah diberikan kepadanya akan menjual obyek jaminan tersebut untuk mengambil pelunasan piutangnya. Berdasarkan hal-hal tersebut maka permasalahan yang akan diteliti dalam peneltian ini adalah: pelaksanaan kuasa jual yang terkait dengan perjanjian utang piutang dalam praktek dan perlindungan hukum bagi pemberi kuasa dalam pelaksanaan kuasa jual yang terkait dengan perjanjian utang piutang. Metode pendekatan yang digunakan adalah pendekatan yuridis empiris dan spesifikasi yang digunakan dalam penelitian ini bersifat penelitian deskriptif analitis. Berdasarkan hasil penelitian dapat disimpulkan bahwa pemberian kuasa menjual untuk menjamin pelunasan utang pihak kreditur apabila debitor wanprestasi tidak dapat dilakukan mengingat hal tersebut mengandung resiko hukum bagi para pihak, khusus pemberi kuasa mengingat dengan kuasa menjual tersebut penerima kuasa dapat menjual setiap saat obyek kuasa terlepas dari terjadinya wanprestasi atau tidak. Sehingga hal ini tidak dapat memberikan perlindungan dan kepastian hukum. Oleh karena itu Notaris akan menolak untuk membuatkan suatu kuasa menjual.yang berkaitan dengan perjanjian utang piutang. Kuasa menjual dapat diberikan untuk mengeksekusi obyek Hak Tanggungan secara penjualan di bawah tangan sebagaimana diatur di dalam ketentuan Pasal 20 ayat (2) Undang-Undang RI Nomor 4 tahun 1986 tentang Hak Tanggungan atas Tanah. Perlindungan hukum bagi pemberi kuasa dalam pembuatan kuasa menjual dapat diberikan apabila akta kuasa menjual tersebut dibuat dalam suatu akta otentik yang merupakan alat bukti yang sempurna. Selain hal tersebut Pasal 1800-1806 KUHPerdata yang mengatur kewajiban penerima kuasa merupakan sutu bentuk perlindungan hukum yang diberikan oleh undang-undang kepada pemberi kuasa
