Mediation Solution as an Approach to Ensuring Rights and Interests

In the article the questions of mediation and deciding on the mediation results are analyzed. Attention is accented, that the aim of mediation is to search not guilty in the situation, and a solution acceptable to both sides. The main thing is that both sides believed that this solution is optimal and acceptable. Summarizing all the procedural aspects of mediation made the following findings: positive mediation procedure is reflected in an agreement between the parties on the current conflict; the results of the mediation the parties hereby mutually accepted solution; a solution that the parties have adopted their own and find it right and just for themselves, usually executed them voluntarily = У статті досліджено питання проведення процедури медіації та прийняття рішення за результатами медіації. Акцентується увага, що метою медіації є пошук не винного у ситуації, а рішення, прийнятного для обох сторін. Головне, щоб обидві сторони вважали, що це рішення є оптимальним та прийнятним. Узагальнивши усі процедурні моменти проведення медіації, зроблено такі висновки: позитивний результат процедури медіації виражається в досягненні згоди між сторонами щодо існуючого конфлікту; за результатами проведеної медіації сторони добровільно приймають взаємовигідне рішення; рішення, яке сторони прийняли самостійно та вважають його правильним і праведливим для себе, як правило, виконується ними також добровільн
