L'ouverture à la concurrence des TER, une opportunité d'affirmation de l'AOT régionale en tant que chef de file de l'organisation des transports régionaux ?

The French regions have taken the responsibility to provide public regional passenger transport services for more than a decade. They have invested a lot in this policy but are now facing institutional and financial challenges. The European railway reforms will force the French regions to allow tendering procedures to be passed for their passenger services. The debate taking place in France on the liberalization of these services and on rail competition may be an opportunity for the French regions to be heard. Will they be able to weigh on the decisions that will have to be taken by the government? Can they use the opportunity of this debate to become real powerful local public authorities with the means and the capacity to implement their transport policies? To be heard, the French regions must propose ambitious ideas and solutions in the national debate. In order to do so, they can use the examples of European countries where on-rail competition is already taking place. This masters' thesis presents the major investment of the regions in public regional passenger transport services and the challenges that they are now facing. Then it describes the evolution of the European context, and the results of the reforms implemented in Great-Britain, Germany and Sweden. Eventually, it studies the scope of their actions in order to evaluate the chances of the regions to be heard.Les régions françaises se sont investies fortement dans le transport ferroviaire de voyageurs depuis qu'elles en ont la compétence. Alors qu'elles sont à l'origine d'un certain nombre d'actions fortes, elles se demandent aujourd'hui comment elles pourront maintenir les services qu'elles ont développés dans un nouveau cadre législatif européen. En effet, l'ouverture à la concurrence des Transports Ferroviaires Régionaux semble inévitable à terme. L'occasion du débat de l'ouverture à la concurrence est donc un moment clé pour les régions. Sauront-elles défendre leurs positions au niveau national et européen pour faire évoluer le système ferroviaire français dans un sens qui leur serait favorable ? Vont-elles pouvoir enfin devenir des Autorités Organisatrices possédant les moyens de leurs actions ? Pour se faire entendre, les régions doivent proposer des solutions ambitieuses dans le débat national. Pour cela, elles peuvent se servir des exemples européens. Ce mémoire présentera donc l'engagement massif des régions dans ce domaine puis les enjeux auxquels elles sont confrontées. Ensuite, il décrira les évolutions proposées par l'UE et les solutions développées au Royaume-Uni, en Allemagne et en Suède. Enfin, il décrira la manière dont les régions agissent pour s'affirmer dans ce débat et les limites de leur mode d'action afin d'évaluer leurs chances de réussite
