Sobre o texto jurídico: gramática e textualidade

Human sciences usually deal with issues related to the variation of the object they study. Therefore, they have to face the dilema of understanding themselves as science or not, since formalism is left aside, and the reasonable observation of the phenomena is privileged, plenty of times. That is what is observed in Lingüistics and in Law studies, since both work with the relation among individuals. This thesis presents issues in Linguistics related with the production of forensic texts. The study tries to estabilish a connection between the two sciences, understanding that, with the Linguistic help, Law studies would present more eficacy. In this work we try to identify the main problems in the production of forensic texts, in order to propose further solutions that would guarantee their eficacy. This thesis proposes that one of the major problems in the forensic discourse is that it is not presented in Brazilian Portuguese, and it would generate misunderstandings in those people who is interested in the process itself, although not being lawyers. It could generate social exclusión, since the Access to justice would be neglected. It is proposed that the forensic texts should be adequated to social needs, and it could happen with the help of Linguistics.As ciências humanas normalmente lidam com questões relativas à variação do objeto de estudo. Assim, acabam deparando com dilema de se entenderem ou não como ciência, tendo em vista que, grande parte das vezes, o formalismo é deixado de lado, e a razoabilidade na observação dos fenômenos é privilegiada. Isso é o que se observa tanto na Lingüística quanto no Direito, pois ambas trabalham com transformações que têm como base o indivíduo e sua relação com o outro. Este trabalho apresenta questões lingüísticas relacionadas à produção de textos jurídicos. Procura-se estabelecer uma conexão entre as duas ciências, a partir do entendimento de que, com o auxílio da Lingüística, os textos de caráter jurídico poderiam apresentar maior eficácia. Partindo dessa premissa, identificam-se, primeiramente, os principais problemas na redação de peças processuais, para, posteriormente, apresentar possíveis soluções que garantam a eficácia dos mesmos. Entende-se que o discurso de produção de textos de natureza jurídica não estaria representando a língua portuguesa em sua modalidade brasileira, o que geraria impossibilidades de entendimento por parte de pessoas leigas, que, apesar disso, seriam interessadas no processo. Isso causaria, dessa forma, uma exclusão social, visto que não se observariam garantias legais dos cidadãos, uma vez que estaria sendo negligenciado o acesso ao judiciário e, conseqüentemente, à Justiça. Uma das formas que fariam com que tal garantia se tornasse eficaz seria a adequação do discurso jurídico às necessidades e anseios sociais.
