Annotation. Based on scientific research and the views of scientists, based on a bibliography of sources and literature used, analyzes the process of formation, development and decline of the state and law during the Cossack era. The works of domestic thinkers, representatives of Ukrainian political and legal thought, in which the ideas of the Cossack statehood as a national state idea are presented, are studied. The problem is of special socio-political significance in Ukraine Cossacks acquires from the second half of the XVI century. During the Cossack period, processes took place that determined the peculiarities of the formation and development of the modern Ukrainian state. An important stage in the assertion of Ukrainian statehood was Zaporizhya Sich - a socio-political and military-administrative organization of the Ukrainian Cossacks. During the Hetmanate and the Cossack era, Ukraine was part of the Commonwealth, and then the Moscow state. As a result of the liberation war of the Ukrainian people against the Polish nobility, national-territorial autonomy was created for the Cossack population of Ukraine. The law on the Ukrainian lands in the days of the Cossacks had different sources and was characterized by the then economic situation. On the one hand, this is the emergence of a small owner, and on the other - the growth of large land ownership. Contrary to the official policy of individual states to limit and further the complete elimination of Ukrainian statehood and despite the agreement of the majority of officers and nobility in the Ukrainian Cossack state during its existence in the XVIII century the national-state idea continued to exist, carried by the best, educated representatives of the Ukrainian elite. The Cossacks, having taken over the functions of governing the state within the Ukrainian Cossack state, enshrining in legal acts, including interstate agreements, rights and privileges as the leading social stratum, took shape as a separate full-fledged social class.
