Pembatalan Perjanjian Pengikatan Jual Beli Akibat Perjanjian Tidak Memenuhi Suatu Hal Tertentu

Judul tesis ini adalah PEMBATALAN PERJANJIAN PENGIKATAN JUAL BELI AKIBAT PERJANJIAN TIDAK MEMENUHI SUATU HAL TERTENTU, permasalahan yang di kaji dalam tesis ini mengenai pertimbangan hakim dalam menentukan Perjanjian Pengikatan Jual Beli adalah Batal Demi Hukum telah sesuai dengan hukum yang berlaku di Indonesia. Metode penelitian yang digunakan adalah penelitian normatif dengan menggunakan pendekatan peraturan perundang-undangan (statute approach), dan pendekatan konseptual (conseptual approach) serta pendekatan kasus (case approach). Hasil kajian menunjukan bahwa Perbuatan yang dilakukan oleh Tergugat merupakan Perbuatan Melawan Hukum, karena telah menjual tanah bukan miliknya, dan Majelis Hakim berpendapat berdasarkan fakta hukum yang ada, bahwa Pengikatan Perjanjian Jual Beli yang dilakukan oleh Penggugat dan Tergugat tidak memenuhi unsur obyektif Pasal 1320 KUHPerdata yaitu pada unsur yang ketiga suatu hal tertentu. Karena obyek kepemilikan tanah tersebut belum pasti sehingga Pengikatan Perjanjian Jual Beli antara Penggugat dan Tergugat menjadi batal demi hukum.The title of this thesis is CANCELLATION OF THE SALE BUYING BINDING AGREEMENT DUE TO THE AGREEMENT OF NOT MEETING A CERTAIN THING, the problem examined in this thesis regarding the judge's consideration in determining the Sale and Purchase Binding Agreement is null and void in accordance with applicable law in Indonesia.
