KARAKTERISTIK RISIKO DALAM PERJANJIAN PENGIKATAN JUAL BELI HAK ATAS TANAH YANG PEMBAYARANNYA BERBASIS KREDIT BANK (STUDI KASUS DI NOTARIS SLT KABUPATEN MALANG)

The sale and purchase agreement is regulated in Article 1457 which reads "A sale and purchase is an agreement whereby one party binds himself to deliver an item, and the other party pays the promised price". This study aims to determine how the characteristics of the risk in the agreement so that the research method used is an empirical legal research method. The primary data sources were taken by conducting direct interviews with the parties concerned, both sellers, buyers and notaries. Based on the results of the study, that an agreement had occurred between the seller and the buyer of the land, but the mechanism of the agreement did not work properly, namely the signing of the Sale and Purchase Deed even though the payment for the land had not been paid off, which in turn caused a risk for the seller himself
