O CASO BELO MONTE E A PROTEÇÃO INTERAMERICANA DOS DIREITOS HUMANOS: A REAÇÃO DO ESTADO BRASILEIRO

This paper analyses the importance of the Inter-American System of Human Rights (ISHR), the Organization of American States (OAS), and the protection of human rights (HR) of indigenous peoples affected by the construction of the Belo Monte hydroelectric. To be inserted into this regional system for the protection of HR, Brazil should take the necessary steps so that the life and integrity are ensured of indigenous communities affected, even if committed in opposition to the application of energy development. Hence, this paper will analyse the precautionary measures issued by the InterAmerican Commission on Human Rights (IACHR) to the State and the reaction of the country. The first injunction demanded that the country paralysed the works of Belo Monte to meet the suggested requirements, causing the contrary, incisive reaction of the Brazilian government in several instances.Este artigo analisa a importância do Sistema Interamericano de Direitos Humanos (SIDH), da Organização de Estados Americanos (OEA) e a proteção dos direitos humanos (DH) dos índios afetados com a construção da Hidroelétrica de Belo Monte. Por estar inserido nesse sistema regional de proteção aos DH, o Brasil deve tomar as devidas providências para assegurar a vida e a integridade das comunidades indígenas afetadas, mesmo que em contraposição ao comprometido com a aplicação do seu desenvolvimento energético. Assim, o artigo analisará as medidas cautelares proferida pela Comissão Interamericana de Direitos Humanos (CIDH) ao Estado Brasileiro e a reação do país. A primeira, exigiu que o país paralisasse as obras de Belo Monte até cumprir as exigências sugeridas, causando a reação contrária e incisiva do governo brasileiro em várias instâncias
