L'anticipation successorale à l'épreuve de l'ordre public successoral

The law of succession and gifts, and more generally the law of transmission, is based on a balance between the will of the deceased and its limits. This dyarchy has structured the law since its inception, offering both a protective balance of power to the heirs and a great deal of latitude to the deceased to anticipate the consequences of his future succession according to his will. We theorize that this dyarchy - which is particularly fragile - materializes in the interdependence between the two notions of anticipation of succession and public order of succession, which mirror the will and the limits. For several years, the growing influence of the will has had consequences for the evolution of the coercive rules of transmission. In domestic law, this influence is prompted by a movement of neo-liberalism in succession. In international law, the balance of transmission is also being tested. Anticipation of succession, driven by the autonomy of the will and the imperative need for predictability, is flourishing, taking advantage of a discreet counter-power and a fundamentalization of public order. Thus, the increasingly important influence of the will and its modes of expression has created a new equilibrium, even an imbalance, between the structuring notions of the transmission dyarchy. Balance in the law of succession is more than just a theoretical matter; it is also necessary for the efficient practice of the matter. Since anticipatory thinking is based on both the will of the deceased and its predictability, the erasure of the control of the will by the evolution/erasure of coercive rules telescopes predictability and weakens the practice of transmission. Since the will knows no limits in abstracto, it cannot regulate itself and tends to transform a legal matter into a judicial matter, leaving it to the judge to control the will of the deceased. The inheritance litigation that would be consubstantial with this would greatly prejudice the very nature of the anticipation of inheritance. Aware nevertheless that the matter must adapt to the changing aspirations of society, it is necessary to propose an evolution of the matter while preserving this precious balance.Le droit des successions et des libéralités, et plus généralement le droit de la transmission, est fondé sur un équilibre entre la volonté du de cujus et ses limites. Cette dyarchie structure la matière depuis son origine offrant tantôt un rapport de force protecteur pour les héritiers tantôt une grande latitude au de cujus pour anticiper selon sa volonté les conséquences de sa succession future. Nous théorisons que cette dyarchie - particulièrement fragile - se matérialise dans l’interdépendance entre les deux notions que sont l’anticipation successorale et l’ordre public successoral, miroir de la volonté et des limites. Depuis plusieurs années, l’influence croissante de la volonté a eu des conséquences sur l’évolution des règles coercitives de la transmission. En droit interne, cette influence est incitée par un mouvement de néolibéralisme successoral. En droit international, l’équilibre de la transmission est aussi mis à l’épreuve. L’anticipation successorale, portée par l’autonomie de la volonté et l’impérieux besoin de prévisibilité, s’épanouit, profitant d’un contre-pouvoir discret et d’une fondamentalisation de l’ordre public. C’est ainsi, que l’influence de plus en plus importante de la volonté et de ses modes d’expression est venue créer un nouvel équilibre, voire un déséquilibre, entre les notions structurantes de la dyarchie de transmission. Or, l’équilibre dans le droit successoral, au-delà d’être purement théorique, est notamment nécessaire pour la pratique efficiente de la matière. La réflexion anticipative se fondant à la fois sur la volonté du de cujus et sa prévisibilité, l’effacement du contrôle de la volonté par l’évolution/l’effacement des règles coercitives télescope la prévisibilité et fragilise la pratique de la transmission. Ne connaissant pas de limites in abstracto, la volonté ne peut s’autoréguler et tend à transformer une matière juridique en une matière judiciaire, laissant au juge le soin de contrôler la volonté du défunt. Le contentieux successoral qui en serait consubstantiel préjudicierait grandement à la nature même de l’anticipation successoral. Conscient néanmoins que la matière doit s’adapter aux évolutions des aspirations de la société, il est alors nécessaire de proposer une évolution de la matière tout en conservant ce précieux équilibre
