Openness Towards European Law and Cooperation with the Court of Justice Revised : the Bundesverfassungsgericht Judgment of 21 June 2016 on the OMT Programme

La sentenza della Corte costituzionale federale tedesca del 21 giugno 2016 sul programma di "Outright monetary transactions" della Banca Centrae Eurpea conferma un atteggiamento di recente assunto da questa Corte, nell'ambito della cd. procedura di controllo ultra vires, di minore cooperazione con la Corte di giustizia dell'Unione europea. La Corte costituzionale federale tedesca, infatti, per quanto basi la propria pronuncia sulla senenza resa in via pregiudiziale dalla Corte di giustizia nel caso Gauweiler il 16 giugno 2015, crtica duramente il ragionamento seguito da quest'ultima. Inoltre, benché la Corte tedesca riconosca alla sentenza pregiudiziale effetti giuridici molto ampi, rafforza in realtà le sue prerogative nei confronti della Corte di giustizia.The Judgment of the Federal Constitutional Court (FCC) of 21 June 2016 on the OMT Programme can be considered as the reaffirmaion of a recent, less cooperative, approach of his Court towards the Court of Justice of the European Union (CJEU) in the ultra vires review procedure. Indeed, while basing its decision on the CJEU 's Gauweiler preliminary ruling of 16 June 2015, the FCC criticizes harshly the legal reasoning followed by the CJEU therein. Moreover, the FCC attributes broad legal effects to Gauweiler, but, in so doing, it strenghtens ts prerogatives towards the CJEU
