Marco legal da primeira infância e mães no cárcere: uma análise sob a luz do Sistema de Garantias

The study aims to examine critically the matter of implementation of the right to familial and community living of the children of women who are imprisoned preventively. Para tanto, analisase a aparente colisão entre o jus puniendi e o princípio do Melhor Interesse da criança, em específico quanto ao cabimento das prisões domiciliares, de grávidas ou com descendentes até doze anos. Com fundamento doutrinário na teoria do sistema garantista de Luigi Ferrajoli, a pesquisa investiga os impactos das Regras de Bangkok no cenário nacional bem como os reflexos do Marco Regulatório da Primeira Infância. Amparados pelas proposições de Sposato, Vygotsky e Wallon pretende-se por meio do conceito de criança, do ponto de vista legal e psico-pedagógico, na perspectiva do ciclo de vida, fundamentar o porquê da necessidade de políticas e direitos diferenciados ao infante. Por conseguinte, o estudo se concentra em outro ponto de investigação, qual seja: o Habeas Corpus coletivo 143.641, com a finalidade de aferir a aplicação desse precedente, do Supremo Tribunal Federal, no Tribunal de Justiça de Sergipe. Isto posto, a interpretação constitucional torna-se essencial para manutenção do sistema garantista no Estado Democrático de Direito, desde que respeitada a sua essência.
