KONSEP MUNASAKHAH PERSPEKTIF MAQASHID AL-SYARI'AH

This study focuses on analyzing the concept of munasakhah inheritance in the maqashid al-Shari'ah perspective. Munasakhah is an Islamic inheritance concept that discusses multilevel death events, where inheritance has not been distributed to heirs, resulting in a buildup of cases. This raises quite complex problems in its distribution. Therefore, the presence of the munasakhah concept is needed to resolve the case. However, what if the concept of munasakhah is reviewed based on the objectives of Islamic law, is there harmony between the concepts offered and the basic objectives of the Shari'ah. By using a library research approach, this research will examine the concept based on the basic values in Islamic law, namely maqashid al-Shari'ah. The purpose of this study is to build a new understanding regarding the existence of the munasakhah concept which is used as a reference in solving multilevel inheritance problems. So that this research can protect the rights of the heirs to the deceased heirs. The results of this study indicate that the concept of inheritance is in line with the values contained in maqashid al-Shari'ah which has a goal to realize the benefit of the people
