Economy of the rights for elementary school teachers: the dilemmas between the absenteeism and the conditioning for the progression in the career

We analyzed the absenteeism of the elementary school teachers at São Paulo State Educational network. We inquired whether the legislation that governs the teaching career establishes rules that promote the usufruct of rights where one right excludes the other one, and whether they are oppressed to opt among different rights. We compared the data of the legislation analysis with the questionnaires. We could observe that São Paulo government applies a policy of controlling absenteeism that does not worry about eradicating its causes relating to working conditions and remunerations, but opts to establish a prohibitive legislation.Analisamos o absenteísmo dos professores do ensino básico da rede estadual paulista. Indagamos se a legislação que rege a carreira docente estabelece regras que promovem o usufruto de direitos excludentes entre si e se eles são confrangidos a optar entre diferentes direitos. Cotejamos os dados da analise da legislação com os questionários. Constatamos que o governo paulista aplica uma política de controle do absenteísmo que não se preocupa em erradicar suas causas referentes às condições de trabalho e à remuneração optando por estabelecer uma legislação coibitiva
