More than a third of countries worldwide have amended their constitutions to protect the environment. Each country has modified its laws in light of its own peculiarities, thereby revealing its particular views on environment protection and conservation. The usage and protection of the environment is inconsistent throughout the world due to the diversity of human societies. This inconsistent treatment of the environment raises grave concerns about the sustainability of the environment as a whole. Twenty-five years later, it is imperative to identify whether there has been significant progress in the implementation of effective laws for the protection of these environmental goods and whether the Constitu-tion has, effectively, brought real changes to Brazilian environmental law. This article will present both historical details and commentary on the implementation of the 1988 Constitutional Provisions. In particular, we will be focusing on the impacts of worldwide backlash against infra-constitutional environmental legislation.Uma das conquistas da Constituição de 1988 o Brasil foi a concessão do status constitucional à proteção do meio ambiente. Mais de um terço dos países do mundo alterou suas constituições para proteger o meio ambiente. Cada país tem modificado suas leis à luz de suas próprias peculiaridades revelando assim as suas visões particulares sobre a proteção e conservação ambiental. O uso e a proteção do meio ambiente é inconsistente em todo o mundo devido à diversidade das sociedades humanas. Este tratamento inconsistente levanta sérias preocupações sobre a sustentabilidade do meio ambiente como um todo. Vinte e cinco anos mais tarde, tornasse imperativo para identificar se houve progressos significativos na implementação de leis eficazes para a proteção desses bens ambientais e se a Constituição tem , efetivamente, trouxe mudanças reais para a legislação ambiental brasileira. Este artigo irá apresentar os detalhes históricos e comentários sobre a implementação das Disposições Constitucionais 1988.
