Avaliação de balneabilidade, impacto multisetorial e cooperação institucional como solução da poluição das praias em João Pessoa

The case of beach pollution in João Pessoa / PB is not new, it is a historical problem published in scientific articles, by the press and now by the internet itself. This scenario has already been widely known by the population and by the general public, which seems to propose palliative proportions and is omitted in more lasting solutions. Anti-oxidants reach the environmental, economic, social, tourist, sanitary and urban development bias, being one of the forms of communication focused on the same resolutive effects, given its multisectoral demarcation. The study aims at, the moment of this scenario, competitiveness in another path (legal-judicial) which interlider peacefully the purpose of legitimados for waste partially or entirely to pollution of beaches. The path provides an instrument of executive and legal control, linking the agents, separating the common and real elusive ones from the lack of personnel, scarcity of resources and incompetence due to matter, legality and / or territoriality. The lack of political will or resistance to institutionality precludes a proposal of the organs themselves, a tendency of participation of electoral authorities such as the Public Prosecutor's Office and the Brazilian Bar Association, as well as resistances of an eminently non-technical nature, converging to a same challenging but solving purpose. The methodology chosen for the development of this work was chosen to evaluate the need for greater achievement of the objectives of the work. The bargaining agreement is the general objective of achieving the specific objectives of ranging from balancing tests and analyzes to consolidating the convergence of political, social and environmental actors to the final reach. The data, partial results of the records, were bathing in the beaches of João Pessoa, most of the time during the studied period. So far, the institutions have shown good acceptance in the search for solution of the problem, and a Term of Adjustment of Conduct has been signed by all institutions of this nature.NenhumaO caso da poluição de praias em João Pessoa/PB não é novo, trata-se de um problema histórico noticiado em artigos científicos, pela imprensa e agora pela própria internet. Esse cenário já é amplamente conhecido pela população e pelo poder público, este que costuma propor paliativos e omite-se em soluções mais duradouras. Os impactos desta poluição alcançam o viés ambiental, econômico, social, turístico, saúde pública e o desenvolvimentista urbano, sendo necessário uma interação de múltiplas ciências em torno de um mesmo propósito resolutivo, visto seu deslinde multisetorial. O estudo visa, diante deste cenário, avaliar um outro caminho (não-judicial) que interligue pacificamente os órgãos públicos legitimados para solucionar parcial ou inteiramente a poluição de praias. Este caminho proverá de instrumento administrativo com efeitos jurídicos, sendo o link entre os agentes, afastando esquivas comuns e reais da falta de pessoal, escassez de recursos e incompetência em razão da matéria, legalidade e/ou territorialidade. Se a falta de vontade política ou resistência em relacionar institucionalmente impede uma propositura dos próprios órgãos, a tendência da participação de entidades apolíticas eleitoralmente como Ministério Público e Ordem dos Advogados do Brasil, reduzirá as resistências de cunho eminentemente não técnico, convergindo para um mesmo propósito desafiador mas solucionador. A metodologia escolhida para o desenvolver deste trabalho é a pesquisa ação ante a necessidade de investigação e atuação prática para maior alcance dos propósitos do trabalho. O acordo de cooperação institucional é o objetivo geral a ser atingido, para tanto, será necessário transcorrer objetivos específicos perpassando desde os exames e análises de balneabilidade até a consolidação em convergência dos atores políticos, sociais e ambientais para o alcance final. Os dados, derivados dos resultados parciais, mostraram que há baixa balneabilidade nas praias de João Pessoa, a maior parte do tempo durante o período pesquisado. Até o momento, as instituições governamentais demonstraram boa aceitação na busca por solução do problema, tendo sido assinado um Termo de Ajustamento de Conduta por todas as instituições envolvidas nessa temática
