Análise das Ações civis públicas ajuizadas pelo Ministério Público Federal em razão do dano ambiental ocasionado pelas construções irregulares na Praia da Galheta, Laguna/SC

The objective of this monographic work is to analyze the Public Civil Actions filed by the Federal Public Prosecution Office due to the environmental damage caused by the irregular constructions in Galheta Beach, Laguna/SC. For this purpose, the present monograph adopted the following research methods: the approach was quantitative; As for the level, the research is exploratory; and, finally, regarding the procedure, the research used the documentary and the bibliographical, given that data collection was done through the analysis of Public Civil Actions, as well as books, articles and legal doctrines. At the conclusion of the study, it was verified that the Federal Public Prosecutor's Office filed 128 Public Civil Actions using as a basis the insertion of the constructions in the Permanent Preserve Area of Dunes, in Coastal Zone, within the Conservation Unit of the Whale Protection Area, in area of Archaeological Heritage and in Marine Lands. In addition, the Ministerial Part supported the damaging transposition of the dunes into access to buildings, objective civil liability for the cause of environmental damage, and the need to accrue compensation for irreversible damage to the environment. Regarding environmental damages, it was verified that the expertise identified the alteration of the dunares physiognomies, the introduction of exotic species and the threat to the archaeological patrimony. With regard to the procedural process, it was verified that 63% are in recursal phase; 19% are in the decision making phase; 9% are in the instructional phase; 5% have already begun to comply with the sentence; 2% were downloaded and filed; and 2% are in postulatory phase. Finally, although most of the lawsuits are still pending, it has been concluded that the Federal Public Prosecutor's Office has been discharging its Constitutional duty to protect the environment, which is essential to human viability on earth.O presente trabalho monográfico tem como objetivo Analisar as Ações Civis Públicas ajuizadas pelo Ministério Público Federal em razão do dano ambiental ocasionado pelas construções irregulares na Praia da Galheta, Laguna/SC. Para esse fim, a presente monografia adotou os seguintes métodos de pesquisa: quanto à abordagem, utilizou-se a de natureza quantitativa; quanto ao nível, a pesquisa é exploratória; e, por fim, quanto ao procedimento, a pesquisa empregou o documental e o bibliográfico, tendo em vista que a coleta de dados se deu por meio da análise de Ações Civis Públicas, bem como de livros, artigos e doutrinas jurídicas. Ao concluir o estudo, constatou-se que o Ministério Público Federal ajuizou 128 Ações Civis Públicas utilizando como fundamentos a inserção das construções em Área de Preservação Permanente de Dunas, em Zona Costeira, dentro da Unidade de Conservação Área de Proteção da Baleia Franca, em área de Patrimônio Arqueológico e em Terrenos de Marinha. Outrossim, o Órgão Ministerial sustentou a transposição danosa das dunas para realizar o acesso nas edificações, a responsabilidade civil objetiva do causador de danos ambientais e a necessidade de cumulação de uma indenização pelos danos irreversíveis ao meio ambiente. Quanto aos danos ambientais, constatou-se que a perícia identificou a alteração das fisionomias dunares, a introdução de espécies exóticas e a ameaça ao patrimônio arqueológico. No que tange ao trâmite processual, verificou-se que 63% estão em fase recursal; 19% estão em fase decisória; 9% estão em fase instrutória; 5% já tiveram iniciado o cumprimento de sentença; 2% foram baixados e arquivados; e 2% estão em fase postulatória. Por fim, embora a maioria das ações ainda estejam em tramitação, concluiu-se que o Ministério Público Federal vem se desincumbindo do seu dever Constitucional de tutelar o meio ambiente, bem essencial à viabilidade humana na terra
