ANALISIS YURIDIS SOSIOLOGIS PERJANJIAN WAKAF UANG PADA BANK MUAMALAT KANTOR CABANG MALANG

The issue of waqf money is due to the potential value of waqf money in Indonesia. The concentration of uneven money waqf funds is only on the Indonesian Waqf Agency located in Jakarta. One of the factors that can make a person's interest in carrying out waqf money is the various forms of agreement and effectiveness of implementation in Islamic Financial Institutions of Waqf Money Recipients (LKS-PWU), in this study is Bank Muamalat Malang Branch Office which has received waqf money since 2008. From the system of agreement and the effectiveness of the implementation, it will form a trust that will multiply the community to make money for the betterment of the people. In order to achieve the purpose and purpose of this research, the theories used are waqf law theory, civil law theory, and legal effectiveness theory. The approach is a sociological juridical approach through interviews. The results of the following research, the implementation of waqf money basically there are two kinds, namely directly and indirectly. The agreement is in a period of time forever or within a certain period of time. At Bank Muamalat itself only performs the waqf process of money directly because it does not have an internet-based support system or software. So that it is considered less in compliance with obligations in the enforcement of existing rules. The statement of will that must be written in the agreement process is not attached. So that Bank Muamalat does not implement the rules that have been set. Related to the effectiveness of the law that is implemented. Implementation of the money waqf agreement process at Bank Muamalat can be said to be ineffective. Seeing that there has been no fulfillment of the implementation of the agreement process by law enforcement who control this money waqf field. This is indicated by the absence of a statement of will attached at the time of the implementation of the waqf money agreement. as well as facilities and suggestions that cannot be said to be met. The unable to fulfill Bank Muamalat fulfills its obligations in the provision of internet-based systems or software, because it is still in the process of development in the matters that are prioritized that are more often used by. So that this system should be developed simultaneously considering this is an obligation to improve the performance of waqf receipts
