L'employeur dans le système du recouvrement social

The financing of social security and, in particular, of the general system, is essentially ensured by the social contribution and the contributions instituted with reference to this one. This results from the historic choice of public authorities, made from the first social insurance laws, to place the burden of financing on the productive forces of the nation, namely the parties to the employment contract. These specific and assigned compulsory deductions, distinct from tax, are the subject of a dedicated collection which was gradually established before flourishing within the new framework of Social Security. It then appeared necessary to entrust the recovery of the social claim to social security bodies specially designed for this purpose : the URSSAF. Their effectiveness will be increased by their networking under the aegis of a central body, ACOSS. The dynamic then at work will not stop at social contributions alone and will go beyond the scope of the general system so that the URSSAF network is on the way to establishing itself today as the only operator operator of the social security contribution collection. How then to explain such success ? This is because the social security contribution collection is based from the outset on a particular balance which makes the employer an actor in it. Established as a substitute agent on behalf of URSSAF, the latter was entrusted with certain missions which are based on its spontaneous execution. Far from being obvious, the current balance of social recovery is the result of an evolution that stretches over more than one centurie, which reflects a certain maturity in the relationship between administration and contributors.Le financement de la sécurité sociale et, en particulier, du régime général est essentiellement assuré par la cotisation sociale et des contributions instituées en référence à celle-ci. Ceci résulte du choix historique des autorités publiques, réalisé dès les premières lois d'Assurance sociale, de faire supporter le poids du financement sur les forces productives de la nation, à savoir les parties au contrat de travail. Ces prélèvements obligatoires spécifiques et affectés, distincts de l'impôt, font l'objet d'un recouvrement dédié qui s'est constitué progressivement avant de s'épanouir dans le cadre nouveau de la Sécurité sociale. Il est alors apparu nécessaire de confier le recouvrement de la créance sociale à des organismes de sécurité sociale spécialement prévus à cet effet : les URSSAF. Leur efficacité va être accrue par leur mise en réseau sous l'égide d'un organisme central, l'ACOSS. La dynamique alors à l'œuvre ne va pas s'arrêter aux seules cotisations sociales et va dépasser le périmètre du régime général de telle sorte que le réseau URSSAF est en passe de s'imposer aujourd’hui comme l'opérateur unique du recouvrement en matière de protection sociale. Comment dès lors expliqué un tel succès ? C'est que le recouvrement social repose dès l'origine sur un équilibre particulier qui fait de l'employeur un acteur de celui-ci. Institué en qualité d’agent de substitution pour le compte de l'URSSAF, ce dernier s'est vu confier certaines missions qui reposent sur son exécution spontanée. Loin de relever de l'évidence, l'équilibre actuel du recouvrement social est le fruit d'une évolution qui s'étire sur plus d’un siècle, laquelle traduit une certaine maturité des rapports entre administration et cotisants
