Legal language and the phenomenon of polysemy in the judgments of the Supreme Court of Spain

Celem niniejszej pracy jest potwierdzenie istnienia polisemii w wyrokach Sądu Najwyższego Hiszpanii oraz wykazanie, że zarówno to zjawisko, jak i specyfika języka prawniczego mogą utrudniać lub wręcz uniemożliwiać zrozumienie tekstu przez przeciętnego użytkownika języka hiszpańskiego, niebędącego specjalistą z dziedziny prawa. W części teoretycznej opisujemy hiszpańskie sądownictwo, koncentrując się na jego strukturze i kompetencjach organów wchodzących w jego skład. Przedstawiamy definicję języka standardowego oraz pojęcie języków specjalistycznych wraz z krótką charakterystyką. Poświęcamy szczególną uwagę językowi prawniczemu, wymieniając jego najistotniejsze cechy. Przedstawiamy definicje polisemii opracowane przez wielu językoznawców, rodzaje tego zjawiska oraz przyczyny powstawania. Omawiamy także rozróżnienie między polisemią a homonimią. W części praktycznej opracowaliśmy korpus składający się z fragmentów wyroków, w których występują słowa potencjalnie polisemiczne. W trakcie badań staraliśmy się ustalić, czy zjawisko to występuje w przypadku analizowanych słów, co utrudnia zrozumienie tekstu, czy też istnieją elementy, które determinują znaczenie do tego stopnia, że polisemia zanika. Wartością dodaną pracy jest analiza słownictwa specjalistycznego, charakterystycznego dla tekstów prawniczych, które może sprawiać problemy w ich interpretacji.The aim of this thesis is to confirm the existence of polysemy in the judgments of the Spanish Supreme Court and to demonstrate that both this phenomenon and the specificity of legal language can make it difficult or impossible for ordinary users of the Spanish language who are not specialized in law. In the theoretical part, we describe the Spanish judiciary, focusing on its structure and the competences of the organs that compose it. We present the definition of standard language and the concept of specialist languages with a short characterization. We pay special attention to the legal language, listing the most significant features. We present the definitions of polysemy established by numerous linguists, the types of this phenomenon, and the causes of its creation. We also discuss the differentiation between polysemy and homonymy. In the practical part, we have elaborated a corpus constituted by fragments of sentences in which potentially polysemic words are presented. Throughout the research, we tried to determine whether this phenomenon occurs in the case of the analyzed words, which makes the text difficult to understand, or whether there are elements that determine the meaning so that the polysemy disappears. The added value to the work is the analysis of specialized lexicon, characteristic for legal texts, which can be problematic in terms of interpretation.El objetivo del presente trabajo es confirmar la existencia de la polisemia en las sentencias del Tribunal Supremo de España y demostrar que tanto este fenómeno como la especificidad del lenguaje jurídico pueden dificultar o imposibilitar su comprensión por parte de los usuarios medios de la lengua española no especializados en derecho. En la parte teórica, describimos el poder judicial español, centrándonos en su estructura y en las competencias de los órganos que lo componen. Presentamos la definición de lengua estándar y el concepto de lenguajes específicos junto con una breve caracterización. Prestamos especial atención al lenguaje jurídico enumerando sus rasgos más significativos. Exponemos las definiciones de la polisemia establecidas por numerosos lingüistas, los tipos de este fenómeno y las fuentes que pueden originarlo. Asimismo, hablamos sobre la diferenciación entre polisemia y homonimia. En la parte práctica, hemos elaborado un corpus constituido por fragmentos de las sentencias en los que se presentan palabras potencialmente polisémicas. A lo largo de la investigación intentamos determinar si en el caso de los vocablos analizados se produce este fenómeno, lo que provoca que el texto sea difícil de comprender, o más bien existen elementos que determinan el significado por lo cual la aparente polisemia desaparece. El valor añadido al trabajo es el análisis de léxico especializado, característico para textos jurídicos, que puede resultar problemático en cuanto a su interpretación
