TINJAUAN YURIDIS KRIMINOLOGIS PELAKU RESTO ABAL-ABAL PADA LAYANAN GRABFOOD YANG MENYEBABKAN KERUGIAN TERHADAP DRIVER GRAB (Studi Kasus Driver Grab di Kota Malang)

The phenomenon of fake restaurants in the city of Malang, which occurred around the beginning of 2019 to early 2020, is a fraud or violation that can harm drivers, including loss of time so that drivers cannot get maximum daily incentives and unilateral termination of employment by PT. . Grab Indonesia so that Drivers no longer have jobs. This study aims to find out how the practice of fake restaurants in Malang City and to find out the factors that cause fake restaurant practices in Malang City and the protection of Grab drivers who suffer losses due to fake restaurants. The research location is in Malang City with direct interviews with several Grab Community Leaders in Malang City as representatives of Drivers who are affected by fake restaurants. This is done to obtain primary data and this study also uses literature research methods. The results obtained from this study are the mechanism and development of fake restaurant practices in Malang City, the factors causing the occurrence of fake restaurant practices in Malang City are economic factors, socio-cultural factors, community factors, law enforcement factors, losses. experienced by Grab Drivers due to fake restaurants, efforts made by the Grab community, efforts made by PT. Grab Indonesia and the efforts of the Malang Regional Police in tackling fraudulent practices in fake restaurants and legal protection for drivers
