PEMIDANAAN TERHADAP PELAKU YANG SEKALIGUS KORBAN KEJAHATAN (PENDEKATAN KRIMINOLOGIS DAN VIKTIMOLOGIS)

The number and various crime is getting more increasing as the development of the society. The increasing crime makes the judge in making law decision seems to be more difficult and complicated. Law decision of the judge is the top spot of the case. As we know Indonesia’s criminal law has determined criminal sanctions if they are proved doing criminal action, therefore crime is getting more increasing. The criminal object is, then, overtaken to the victim of crime and not only to the criminal instead. But then if in some case, the criminal is as the victim as well, so the judge will make law decision in different ways of considerations. This type of research used by the author in this study is normative.
