PERTIMBANGAN HAKIM DALAM MENJATUHKAN PIDANA TERHADAP SESEORANG YANG DITUDUH MELAKUKAN TINDAK PIDANA PENISTAAN AGAMA (Studi Putusan atas Perkara Meliana)

The title of this legal writing is the judge's judgment in imposing a crime against someone accused of a crime of blasphemy (a study of the verdict on the Meliana’s case). Various injustices and inaccuracies in the application of law in blasphemy law in Indonesia indicate that legal reform must be carried out immediately, so the author feels that this research needs to be done with the formulation of the problem of what is the judge's basis for dropping a criminal on someone accused of a crime blasphemy in the verdict of the Meliana’s case already gives a sense of justice. This legal writing uses a normative method that takes data sources from secondary data consisting of primary legal material in the form of legislation, court decisions, and secondary legal material in the form of literature and research results. The conclusion from this legal writing is that the Panel of Judges did not consider carefully in examining the elements in Article 156a letter a of the Criminal Code. In this article, the element "intentionally" must be proven carefully because this article shows the intention or mens rea of someone's actions that wants the emergence of "hostility, abuse, or blasphemy of religion"
