L’ordre public en droit public français et camerounais : regards croisés sur un labyrinthe juridique

Despite almost identical terminology in France and Cameroon, public order is somewhat different in both countries, whether in terms of its content or its conciliation with freedoms. On the content, if the material dimension of administrative public order is recognized by everyone in France and Cameroon, there are notable divergences in its immaterial dimension. This is in fact expressly enshrined in the Cameroonian texts, whereas it was by praetorian means that it was gradually instituted in France. On the other hand, while Cameroon is illustrated by the absence of a typically constitutional public order, this reality has gradually been imposed in France, where all specialists agree on the existence of a constitutional public order distinct from administrative public order. Concerning the reconciliation between public order and public freedoms which refers to the idea of the control of its use, several differences are notable. On the one hand, the ineffectiveness of the control of the constitutional judge in Cameroon contrasts with the effective and modulable control of the French constitutional judge, who puts in place various control techniques to ensure the safeguarding of public liberties by the so-called police laws. On the other hand, the extensive and circumstantial control exercised by the French administrative judge through the control of the necessity, proportionality and adaptation of police measures differs from the minimum and lax control exercised by the administrative judge of Cameroon on public order measures.Malgré une terminologie quasiment identique en France et au Cameroun, l’ordre public est conçu de manière quelque peu différente dans ces deux pays, qu’il s’agisse de son contenu ou de sa conciliation avec les libertés. Sur le contenu, si la dimension matérielle de l’ordre public administratif est reconnue de tous tant en France qu’au Cameroun, des divergences notoires peuvent être relevées quant à sa dimension immatérielle. Celle-ci est en effet expressément consacrée par les textes camerounais alors que c’est par voie prétorienne qu’elle a été progressivement instituée en France. Par ailleurs, tandis que le Cameroun s’illustre par l’inexistence d’un ordre public typiquement constitutionnel, cette réalité s’est progressivement imposée en France où tous les spécialistes s’accordent sur l’existence d’un ordre public constitutionnel distinct de l’ordre public administratif. Sur la conciliation entre l’ordre public et les libertés publiques qui renvoie à l’idée du contrôle de son utilisation, des différences notoires sont notables. D’une part, l’ineffectivité du contrôle du juge constitutionnel au Cameroun tranche net avec le contrôle effectif et modulable du juge constitutionnel français qui met en place diverses techniques de contrôle pour s’assurer de la sauvegarde des libertés publiques par les lois dites de police. D’autre part le contrôle étendu et circonstancié du juge administratif français à travers le contrôle de la nécessité, de la proportionnalité et de l’adaptation des mesures de police se démarque du contrôle minimum et laxiste opéré par le juge administratif camerounais sur les mesures d’ordre public.Gatsi Eric-Adol.
