A fresh analysis of this famous speech strengthens the idea that Cicero was unable to produce decisive proofs supporting the defendant. His arguments are in fact rather weak and often contradictory, so that some modern scholars have raised doubts about Roscius’ innocence. However, there are not enough reasons to think so. Indeed Cicero could not get to the heart of this affaire, probably in consequence of the gloomy political situation, but Roscius was almost certainly not guilty. In spite of his faulty defensive strategy Cicero won this case and was entirely successful by virtue of the vehemence of his oratory.
