KOMPETENSI / KEWENANGAN BPSK DALAM MEMERIKSA DAN MENGADILI PERKARA ASURANSI (STUDI KASUS PADA PERKARA ANTARA DRS. KHAMDANI DENGAN PT. ASURANSI BINA DANA ARTA TBK. CABANG BANJARMASIN DAN PT. OTO MULTIARTHA CABANG SAMPIT TAHUN 2016)

Consumer Disputes that occur in Indonesia are not something new, where the initial procedure for Settlement of disputes must be resolved in advance through the Consumer Dispute Resolution Agency with decisions that are final and binding, but many BPSK Decisions are canceled by the PN or MA on the grounds BPSK does not have the authority over this matter, so the writer is interested in raising the title of the skype about the Competence / Authority of Bpsk in Examining and Judging Insurance Cases (Case Study on Cases Between Drs. Khamdani and PT Asuransi Bina Dana Arta Tbk. Banjarmasin Branch and PT Oto Multiartha Branch Sampit in 2016) in this study the author raised four issues, namely How the Essence of Judge Considerations in Consumer Protection Disputes in BPSK, PN, Cassation, and PK Decisions? The writing method is to use a short method which is taken from the normative juridical legal method. The technique of gathering legal materials by gathering information on several libraries in universities, and browsing the internet, and websites, and conclusions that the authors took in this study are divided into two categories: First, related to the BPSK decision, in accordance with Article 18 of the UUPK, BPSK has authority to supervise the observance of standard clauses. Secondly according to the Supreme Court Judge, BPSK does not have authority over the dispute because the dispute is not a consumer dispute. as well as advice to the public to be more careful in conducting transactions both sale and purchase and in this case regarding insurance, and suggestions or recommendations that the author gives to the government is necessary to consider structuring the specific laws and regulations in this study to be considered in relation to the BPSK decision which is carried out by means of mediation and consolidation to be strengthened in the BPSK decision
