ANALISIS FORMAT DAN FORMULASI PUTUSAN ARBITRASE PADA BADAN PENYELESAIAN SENGKETA KONSUMEN (BPSK) (Studi Terhadap Putusan BPSK Pemerintah Kota Malang Nomor: 07/P.BPSK/05/2017 dan Nomor 02/P.BPSK/01/2015 Tentang Arbitrase)

Through the Law of the Republic of Indonesia Number 8 Year 1999 on Consumer Protection, Consumer Dispute Settlement Agency (BPSK) was born as an alternative dispute resolution through Arbitration, Conciliation or Mediation. Unfortunately, the existence of BPSK, has legal vacancies in the format and verdict formulations issued through the Arbitration Linebecause of a legal vacuum. Such conditions result in the writing of each Verdict is changed until it can be said have been lost itsexecution power. Through normative legal research methods, by reviewing the laws and regulations (Statue Approach),the concept of legal science (Conseptual Approach) and comparative each legal product by BPSK (Comparative Approach). This research examines the format and formulation of the Verdict of BPSK city malang no.07/P.BPSK/ 05/2017 about the arbitration with the Verdict of BPSK municipal government of malang number 02 / P.BPSK/ 01/2015 about arbitration, and conducted an analysis related to how the format and formulation of the Verdict of Arbitration on a good BPSK. in the Chapter of discussions that have been studied, researcher found this empty condition resulted in the standard writing of each Verdict in Arbitration changed, on the other hand actually the legislation system has given outline of every Verdict of arbitration, especially arbitration in BPSK ideally should be harmonious with 4 values, such as 1) The provisions in the Verdict containing justice, certainty and expediency can be achieved, (2) Principles of Verdict which is translated in Article 178 HIR / 189 RBg, (3) Article 14 paragraph (1) HIR or Article 195 RBG, (4) Article 54 paragraph (1) of the Law of the Republic of Indonesia Number 30 Year 1999 on Arbitration and Alternative Dispute Settlement. The authors' expectation through this research can do normal laying with the format and formulation of Arbitration Verdict on BPSK which is in accordance with the provisions of law regulation and Verdict theory
