A reforma do Sistema Interamericano de Direitos Humanos: entre a necessidade e a utopia

The main objective of this study is to analyze the viability of a reform in the inter-American human rights system (IAHRS), which has its efficiency compromised by the institutional crisis in which it is due to the increase in the demands submitted to the system and its old structure, fifty years after its creation. It has been shown that the American regional system has difficulties to be faced in order to improve its operation. A Reform parameter has already occurred in the pioneering System of the three regional systems currently existing, the European System of Human Rights, which provides guidelines for its implementation, as well as served as a guide to the initial training of the IAHRS. Political conflicts have also been identified within the framework of the Organization of American States, where the Inter-American Human Rights System was born, specifically in the presence and performance of the United States, which directly influence the limits of the System's performance. For the purpose of the research, a classic realistic perspective of international relations was adopted, which studies from an unbelieving and pessimistic perspective about the behavior of States within a society of States. States are considered sovereign, have their own interests and, consequently, conflicting interests when faced with a plurality of States. The study was developed from a bibliographical analysis, trying to explain the problem from the already settled theories; documentary analysis, based on Conventions, Treaties, Laws, Resolutions and Reports; and statistical analysis to obtain the data used; the comparative method was also used to make a comparison between the American and European systems. Thus, from the study carried out, it was possible to conclude that the reform of the Inter-American Human Rights System, although necessary, shows itself to be utopian in the political and institutional context that involves its realization, to demonstrate lack of interest in the ratification of instruments that conflict with interests of sovereign states and, above all, with great power of influence, like the performance of the United States within the Organization of American States. The progressivity and modernity objectifiedat the international level are limited by the States themselves and the possibility of a Reform is placed in a problematic context of necessity and utopia.O presente trabalho de conclusão de curso tem como objetivo principal analisar a viabilidade de uma Reforma no Sistema Interamericano de Direitos Humanos (SIDH), que possui sua eficiência comprometida diante da crise institucional em que se encontra pelo aumento das demandas submetidas ao sistema e o engessamento da sua estrutura desde a sua criação, passados 50 (cinquenta) anos. Demonstrou-se que o sistema regional americano possui dificuldades a serem enfrentadas para melhorar o seu funcionamento. Uma Reforma parâmetro já ocorreu no Sistema pioneiro dentre os três sistema regionais existentes atualmente, o Sistema Europeu de Direitos Humanos, que traz orientações para a sua realização, assim como serviu de orientação para a formação inicial do SIDH. Outrossim, identificou-se conflitos políticos no âmbito da Organização dos Estados Americanos, seio de onde nasce o Sistema Interamericano de Direitos Humanos, especificamente na presença e atuação dos Estados Unidos, que influenciam diretamente nos limites de atuação desse Sistema. Para a finalidade objetivada na pesquisa, adotou-se uma perspectiva realista clássica das relações internacionais, que estuda sob uma perspectiva incrédula e pessimista o comportamento dos Estados dentro de uma sociedade de Estados. Considera-se que os Estados são soberanos, possuem interesses próprios e, consequentemente, interesses conflitantes quando diante de uma pluralidade de Estados.O estudo foi desenvolvido a partir de análise bibliográfica, buscando explicar o problema a partir de teorias já sedimentadas; análise documental, a partir de Convenções, Tratados, Leis, Resoluções e Relatórios; e análise estatística para a obtenção dos dados utilizados; o método comparativo também foi utilizado para fazer uma comparação entre os sistemas americano e europeu. Assim, a partir do estudo realizado foi permitido concluir que a reforma do Sistema Interamericano de Direitos Humanos, apesar de necessária, se demonstra utópica no contexto político e institucional que envolve a sua realização, a demonstrar ausência de interesses na ratificação de instrumentos que conflitem com interesses individuais de Estados soberanos e, sobretudo, com grande poder de influência, como se perfaz a atuação dos Estados Unidos no âmbito da Organização dos Estados Americanos. A progressividade e modernização pretendidas, então, no plano internacional, é limitada pelos próprios Estados e a possibilidade de uma Reforma se coloca num contexto problemático de necessidade e utopia
