PERLINDUNGAN HUKUM BAGI PEMEGANG HAK MEREK DAGANG PRODUK ROKOK SEIRING DENGAN BERLAKUNYA PERATURAN PLAIN PACKAGING ON CIGARETTES AND OTHER TOBACCO PRODUCTS DI AUSTRALIA (Studi Kaus Gugatan Indonesia Kepada Australia Di WTO No. WT/DS467)

Fakultas Hukum Universitas Brawijaya Email : avitiaraptr@gmail.com  ABSTRAK Kemunculan peraturan Plain Packaging Act 2011 di Australia yang mewajibkan setiap produk olahan tembakau harus dijual dengan menggunakan kemasan polos membuat Indonesia dan negara pengekspor rokok lain merasa dirugikan. Indonesia dan negara lain menganggap hak-hak yang dimiliki oleh Pemilik Hak Merek dicederai dengan munculnya peraturan tersebut. Sebagaimana telah diketahui pasal 16(1) dan 16(3) TRIPs telah mengatur ketentuan yang memberikan perlindungan bagi para Pemilik Merek untuk dapat menggunakan hak eksklusif atas merek yang dimiliknya dengan seluas-luasnya. Berawal dari kasus tersebut Indonesia mengajukan gugatan kepada Australia di WTO sebagai tindak lanjut keberatan dari Indonesia sebagai negara pengekspor rokok atas peraturan Plain Packaging Act 2011 tersebut. Penelitian ini dilakukan dengan metode Yuridis-Normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Hasil penelitian menunjukkan bahwa peraturan Plain Packaging Act 2011 di Australia tersebut melanggar pasal-pasal yang terdapat di dalam TRIPs yang telah mengatur perlindungan bagi pemilik hak merek. Kata Kunci: Plain Packaging, Gugatan Indonesia, WTO, TRIPs, Australia. ABSTRACT  Occurrence regulation of Plain Packaging Act 2011 in Australia which require any product processed tobacco to be sold using plain packaging make Indonesia and other cigarettes exporting countries feel aggrieved. Indonesia and other countries consider the rights owned by the controlled rights to the Brand will be violated with the advent of the regulation. As is known in article 16 (1) and 16 (3) TRIps the provisions regulating provide protection for the trademarks' holder to be able to use exclusive rights over the brand with them freely. The case of Indonesia filed a lawsuit to Australia in WTO as a follow-up objection from Indonesia as the top exporting countries smoking regulations Plain Packaging Act 2011. This research was conducted by the method of the last formal education-Normative approach of legislation (Statutes approach) and the approach of the case (case approach). The results showed that the rules of Plain Packaging 2011 in Australia violate articles in TRIPs which arrange protection for the controlled rights to the brand.  Keywords: Plain Packaging, Indonesia Enactment, WTO, TRIPs, Australia.
