Contencioso eleitoral em tempos de judicialização da política: a disputa no Supremo e o Supremo na disputa

The paper draws a panorama of the diffuse control of constitutionality in electoral matters based on decisions of the Federal Supreme Court in extraordinary appeals fi-led against the decisions of the Superior Electoral Court. After the analysis of the electoral procedural system, with emphasis on the broad devolution effect of the special electoral resource, it addresses the Brazilian electoral gover-nance model in which the Higher Electoral Tribunal and the Federal Supreme Court are aligned in the application of the “electoral constitution”. After introducing the phenomenon of the judicialization of politics, the extraordinary resource and decisions of the Supreme Court are examined to map the entrance and exit profile and to identify the effective role of the Court in the electoral litigationO trabalho traça um panorama do controle difuso de constitucionalidade em matéria eleitoral a partir de decisões do Supremo Tribunal Federal em recursos extraordinários interpostos contra os acórdãos do Tribunal Superior Eleitoral. Feita a análise da sistemática dos recursos eleitorais, com ênfase ao amplo efeito devolutivo do recurso especial eleitoral, aborda-se o modelo de governança eleitoral brasileiro em que Tribunal Superior Eleitoral e Supremo Tribunal Federal estão alinhados na leitura da “constituição eleitoral”. Após a análise do fenômeno da judicialização da política, são destrinchados os recursos extraordinários e as decisões do Supremo para, primeiro, mapear o perfil de entrada e saída para, segundo, identificar o efetivo papel do Tribunal no contencioso eleitoral
